HHS Statement Regarding the Cyberattack on Change Healthcare

The U.S. Department of Health and Human Services (HHS) is aware that Change Healthcare – a unit of UnitedHealth Group (UHG) – was impacted by a cybersecurity incident in late February. HHS recognizes the impact this attack has had on health care operations across the country. HHS’ first priority is to help coordinate efforts to avoid disruptions to care throughout the health care system.

HHS is in regular contact with UHG leadership, state partners, and with numerous external stakeholders to better understand the nature of the impacts and to ensure the effectiveness of UHG’s response. HHS has made clear its expectation that UHG does everything in its power to ensure continuity of operations for all health care providers impacted and HHS appreciates UHG’s continuous efforts to do so. HHS is also leading interagency coordination of the Federal government’s related activities, including working closely with the Federal Bureau of Investigations (FBI), the Cybersecurity and Infrastructure Security Agency (CISA), the White House, and other agencies to provide credible, actionable threat intelligence to industry wherever possible.

HHS refers directly to UHG for updates on their incident response progress and recovery planning. However, numerous hospitals, doctors, pharmacies and other stakeholders have highlighted potential cash flow concerns to HHS stemming from an inability to submit claims and receive payments. HHS has heard these concerns and is taking direct action and working to support the important needs of the health care community.

Today, HHS is announcing immediate steps that the Centers for Medicare & Medicaid Services (CMS) is taking to assist providers to continue to serve patients. CMS will continue to communicate with the health care community and assist, as appropriate. Providers should continue to work with all their payers for the latest updates on how to receive timely payments.

Affected parties should be aware of the following flexibilities in place:

  • Medicare providers needing to change clearinghouses that they use for claims processing during these outages should contact their Medicare Administrative Contractor (MAC) to request a new electronic data interchange (EDI) enrollment for the switch. The MAC will provide instructions based on the specific request to expedite the new EDI enrollment. CMS has instructed the MACs to expedite this process and move all provider and facility requests into production and ready to bill claims quickly. CMS is strongly encouraging other payers, including state Medicaid and Children’s Health Insurance Program (CHIP) agencies and Medicaid and CHIP managed care plans, to waive or expedite solutions for this requirement.
  • CMS will issue guidance to Medicare Advantage (MA) organizations and Part D sponsors encouraging them to remove or relax prior authorization, other utilization management, and timely filing requirements during these system outages. CMS is also encouraging MA plans to offer advance funding to providers most affected by this cyberattack.
  • CMS strongly encourages Medicaid and CHIP managed care plans to adopt the same strategies of removing or relaxing prior authorization and utilization management requirements, and consider offering advance funding to providers, on behalf of Medicaid and CHIP managed care enrollees to the extent permitted by the State. 
  • If Medicare providers are having trouble filing claims or other necessary notices or other submissions, they should contact their MAC for details on exceptions, waivers, or extensions, or contact CMS regarding quality reporting programs.
  • CMS has contacted all of the MACs to make sure they are prepared to accept paper claims from providers who need to file them. While we recognize that electronic billing is preferable for everyone, the MACs must accept paper submissions if a provider needs to file claims in that method.

CMS has also heard from providers about the availability of accelerated payments, like those issued during the COVID-19 pandemic. We understand that many payers are making funds available while billing systems are offline, and providers should take advantage of those opportunities. However, CMS recognizes that hospitals may face significant cash flow problems from the unusual circumstances impacting hospitals’ operations, and – during outages arising from this event – facilities may submit accelerated payment requests to their respective servicing MACs for individual consideration. We are working to provide additional information to the MACs about the specific items and information a provider’s request should contain. Specific information will be available from the MACs later this week.

This incident is a reminder of the interconnectedness of the domestic health care ecosystem and of the urgency of strengthening cybersecurity resiliency across the ecosystem. That’s why, in December 2023, HHS released a concept paper that outlines the Department’s cybersecurity strategy for the sector. The concept paper builds on the National Cybersecurity Strategy that President Biden released last year, focusing specifically on strengthening resilience for hospitals, patients, and communities threatened by cyber-attacks. The paper details four pillars for action, including publishing new voluntary health care-specific cybersecurity performance goals, working with Congress to develop supports and incentives for domestic hospitals to improve cybersecurity, increasing accountability within the health care sector, and enhancing coordination through a one-stop shop.

HHS will continue to communicate with the health care sector and encourage continued dialogue among affected parties. We will continue to communicate with UHG, closely monitor their ongoing response to this cyberattack, and promote transparent, robust response while working with the industry to close any gaps that remain.

HHS also takes this opportunity to encourage all providers, technology vendors, and members of the health care ecosystem to double down on cybersecurity, with urgency. How The Home-Focused Careforth Reduces ED Visits, Falls Through Family Caregiver Support

The United States relies heavily on family caregivers, so much so that the Biden administration has gone lengths to support them . Still, in order for family caregivers to actually reduce the cost of care in the home, they need to be given the proper resources and education.

Otherwise, patients are likely receiving – unbeknownst to them – subpar care that isn’t guaranteed to keep them out of more costly settings.

That’s part of the thesis behind the company Careforth, which is a family caregiver support platform.

A recent analysis conducted by the research and advisory firm ATI Advisory , on behalf of Careforth, found that the company was able to save payers approximately $60,000 per person, per year based on its ability to keep seniors at home. That’s, of course, through its family caregiver guidance.

“From helping caregivers navigate the health care system, to providing them the tools they need to advocate for themselves and the person they care for, to coordinating referrals for necessities like lift beds or ramps, our wraparound support makes it more possible for care to happen safely at home,” Katie Tardiff, Careforth’s SVP of clinical programs and services, told Home Health Care News in an email. “We empower caregivers and provide the tools they need to ensure their loved one’s safety, reduce ED visits and remain in their homes and community – where they most want to be.”

Based in Boston and founded in 2000, Careforth provides care teams for family caregivers. Those care teams connect caregivers with local resources and provide education for dementia care, behavioral health care and other conditions. They do so via in-person at-home visits, as well as virtually.

The ATI analysis also found that there was a 46% lower probability of at least one injurious fall for Careforth’s patients compared to other dual-eligible individuals. That alone is worth an estimated $1,600 in savings per patient, according to ATI.

“After an initial evaluation and assessment, we match each caregiver with a coach and co-create a customized care plan unique to their circumstances and needs,” Tardiff said. “We educate caregivers and provide resources to create awareness, build knowledge and increase confidence so they are prepared to identify changes in condition of their loved one, and intervene to prevent outcomes like falls or emergency department visits. Equipping family caregivers is central to care plan development.”

Furthermore, Careforth helps reduce emergency department visits. There was a 21% lower probability of at least one ED visit in a year under its watch, according to the analysis.

Due to that nationwide caregiver shortage, and the millions of Americans that care for family members, self-directed or consumer-directed payment models have become more common.

The downfall, of course, is when there are either families taking advantage of the payment mechanism or there are underqualified workers trying to manage a loved one’s care.

Careforth’s goal is to negate some of those concerns, so that the seniors and the health care system are actually benefiting from the care being provided.

The care teams regularly connect family caregivers, too, with other home-based care providers.

ATI’s analysis seems to have verified those beliefs.

State Medicaid offices target dead people’s homes to recoup their health care costs

WASHINGTON — As Salvatore LoGrande fought cancer and all the pain that came with it, his daughters promised to keep him in the white, pitched roof house he worked so hard to buy all those decades ago.

So, Sandy LoGrande thought it was a mistake when, a year after her father’s death, Massachusetts billed her $177,000 for her father’s Medicaid expenses and threatened to sue for his home if she didn’t pay up quickly.

“The home was everything,” to her father said LoGrande, 57.

But the bill and accompanying threat weren’t a mistake.

Rather, it was part of a routine process the federal government requires of every state: to recover money from the assets of dead people who, in their final years, relied on Medicaid, the taxpayer-funded health insurance for the poorest Americans.

A person’s home is typically exempt from qualifying for Medicaid. But it is subject to the estate recovery process for those who were over 55 and used Medicaid to pay for long-term care such as nursing home stays or in-home health care.

This month, a Democratic lawmaker proposed scuttling the “cruel” program altogether. Critics argue the program collects too little — roughly 1% — of the more than $150 billion Medicaid spends yearly on long-term care. They also say many states fail to warn people who sign up for Medicaid that big bills and claims to their property might await their families once they die.

LoGrande says that’s how she ended up in a two-year legal battle with Massachusetts after her father died. Several years before he died in 2016, she had turned to a local nonprofit for advice on caring for her elderly father. The group suggested she sign him up for Medicaid. She even remembers asking about the house, but was assured the state would only seek the house if it sent her father to a nursing home.

“He never would have signed on with anything that would put his home in jeopardy,” she said.

For years, her father got an annual renewal notice from the state’s Medicaid office. She says it wasn’t until after his death, when the state’s demand for $177,000 arrived, that she saw the first bill for his care, which included a brief stint in the hospital for pain from cancer, medications and hospice.

“That’s what ripped my guts out,” LoGrande said. “It was dishonest.”

The state settled with the LoGrandes in 2019 and released its claim on the house.

State policies around this recovery process vary widely, according to a 2021 report from the Medicaid and CHIP Payment and Access Commission , which makes policy recommendations to Congress.

Some states will put a lien — a legal right — on a home while others don’t. Meanwhile, some Medicaid offices try to recoup all medical costs from patients, like doctor visits or prescriptions, while others just pursue the costs for long-term care. Alaska and Arizona pursued just dozens of properties in recent years while other states go after thousands of homes, totaling hundreds of millions of dollars.

New York and Ohio topped the country for such collections, recovering more than $100 million combined in a single year, a Dayton Daily News investigation found.

An investigation into the Kansas program, released Tuesday by the Health and Human Services inspector general, found that program was cost effective — yielding $37 million while only spending $5 million to recover the money, But the state didn’t always collect the money from estates that were eligible.

Last month, a foundation for one of the industry’s biggest health insurance giants called on Massachusetts to overhaul its process, which includes collecting reimbursement for most Medicaid costs, beyond the federal government’s minimum requirement to recover long-term care expenses. The Blue Cross Blue Shield Foundation of Massachusetts recommended the state Legislature pass a law that would prohibit those additional collections.

Estate recovery “has the potential to perpetuate wealth disparities and intergenerational poverty,” said Katherine Howitt, a Medicaid policy director with the foundation.

In Tennessee, which recovered more than $38.2 million from more than 8,100 estates last year, Imani Mfalme found herself in a similar predicament after her mother’s death in 2021.

As her mother’s early-onset Alzheimer’s worsened, Mfalme continued to care for her. But in 2015, when Mfalme was diagnosed with breast cancer and needed a double mastectomy, she started looking at other options. She hosted a meeting in her mother’s home with the local Medicaid office. The representative told her to drain her mother’s bank accounts – money Mfalme poured into assisted living facility payments for her mom – so her mother would qualify for the program.

She recalls being somewhat offended during the meeting after the representative asked her three times: “This is your mother’s home?” The representative, Mfalme said, made no mention that she could be forced to sell the house to settle her mother’s bill with Medicaid once she died.

Now, Tennessee’s Medicaid office says she owes $225,000 and the state is seeking a court order that would require Mfalme to sell the house to pay up.

Mfalme, now 42, said she wants to pay what she can, but the house is a particular pain point. Her mother, a Black woman, purchased her dream home in Knoxville after she won a landmark discrimination lawsuit against her former employer, Boeing, for paying her less than her male coworkers.

“She fought hard for equal pay and equal rights. Just to see that ripped away just because she was sick and I was sick, it’s just absolutely devastating,” Mfalme said of her mother.

TennCare, Tennessee’s Medicaid office, said in an email to The Associated Press that it would not comment on specific cases.

The Medicaid and CHIP Payment and Access Commission’s report recommended that Congress reverse the 1993 law that required states to recover money from estates, instead making it optional.

Earlier this month, Democratic Rep. Jan Schakowsky of Illinois reintroduced legislation that would end the federal government's mandate . Schakowsky believes the rule is a losing proposition for families, who give up their homes, and taxpayers, who don’t see big returns from the recovery efforts.

“It is one of the most cruel, ineffective programs that we see,” Schakowsky told the AP. “This is a program that doesn’t work for anybody.”

In a gridlocked Congress, where some Republicans are clamoring to trim Medicaid entitlements, the bill is unlikely to garner the bipartisan support needed to become law.

There’s at least one person who acknowledges the rule isn’t working: the man who engineered it.

Many people don’t know about the decades-old mandate, which was intended to encourage people to save for long-term care — or risk losing the equity from their home, explained Stephen Moses, who now works for the conservative Paragon Health Institute.

“The plan here was to ensure that people who need long-term care can get it but that you plan ahead to be able to pay privately so you don’t end up on the public health care program,” Moses said.

UK home care workers cannot work as visa regime tightened, says employer

Grosvenor says it is prevented from making 3,000 visits a week as it pays migrant workers to sit at home because permits not renewed

One of the UK’s biggest home care providers says it is paying dozens of migrant workers to sit at home and do nothing because the Home Office has not renewed key immigration permits.

Thousands of workers, mostly from Africa, were welcomed into the UK to help fill the one in 10 care worker jobs vacant after the Covid crisis. But after scammers abused the system, leading to allegations of modern slavery, the government appears to have tightened the application of the rules.

“It has gone from one extreme to the other,” said Darren Stapelberg, the chief executive of Grosvenor Healthcare, the UK’s third largest domiciliary care provider, who is paying reduced wages to 30 Zimbabwean workers and faces having to do the same to 90 more in the coming months. “It was very, very easy to sponsor people to come over, but the system has been abused, so now they are making it almost impossible to get new people in and staff who are already here can’t get renewals.”

Eleven of his workers have left the country, despite a care worker shortage of 152,000 across England. “We are losing workers who have made a great contribution to this society, at a time when you could quadruple our workforce and still not have enough staff,” he said.

The newly hostile environment comes after the government issued 106,000 care worker visas in 2023. But hundreds of companies that have never been inspected by the Care Quality Commission (CQC) regulator were granted licences and the chief inspector of borders found that 275 visas were issued to a care home that did not exist.

As part of a crackdown, ministers announced in December that care workers would no longer be able to bring in dependent partners and children. The CQC warned MPs that modern slavery was becoming a feature of the care system.

The Homecare Association has written to the care minister, Helen Whately, warning the Home Office about the problem.

Jane Townson, the chief executive of the industry body, wrote: “The Home Office appears to have lurched from one extreme to the other.

“Even established, high-quality, regulated homecare providers who have sent in evidence of block contracts with councils cannot get certificates of sponsorship extended or issued. Homecare providers are now close to handing back thousands of hours of homecare to councils.”

Already the visa problems were preventing Grosvenor, which serves almost 100 councils in England, Scotland and Wales, from making about 3,000 care visits a week, Stapelberg said.

1st Homecare, which operates in Oxfordshire, Bedfordshire and Hertfordshire, said the Home Office had demanded more than 230 documents, including contracts, care plans and rotas, to prove it had enough work to recruit just one foreign worker who was already in the country on a working visa.

“It was just ridiculous,” said John Rennison, its owner. “It is not helping our national shortage of care workers and it’s an impediment to what we are trying to do, which is look after vulnerable people.”

The worker he was seeking to recruit had only been paid about £60 a week by their previous employer. There have been widespread reports of unscrupulous operators charging foreign workers excessive visa fees and promising working hours that do not materialise.

A Home Office spokesperson said: “Our guidance clearly stipulates for those who have submitted an application for further leave in the UK before their existing leave expired have the same entitlements as their original leave. We require sponsors to show evidence that a genuine vacancy exists at the time the application is submitted. Where there is no evidence to suggest the declared work will be available, applications are not approved.”

Cathie Williams, the joint chief executive of the Association of Directors of Adult Social Services, said: “International recruitment is not a long-term solution to the recruitment crisis in social care. The only way any government is going to address this is to … fund it well enough to provide the pay and working conditions that will attract more people in the UK to do these vital and rewarding jobs.”
