Episode Notes

Amex GBT announced plans on Monday to acquire CWT for $570 million, a deal that would combine two of the world’s largest corporate travel agencies. Travel Technology Reporter Justin Dawes explains why Amex GBT executives are pushing for the megadeal.

Amex GBT CEO Paul Abbott said acquisitions are a key part of its growth strategy, noting the combined company would generate revenue of at least $3 billion. Abbott added acquiring CWT would strengthen several areas of Amex GBT, citing CWT’s footprint in industries such as the media, entertainment and sports.

In addition, Amex GBT also said the acquisition would help produce savings of $155 million within three years.

Next, Boeing’s senior leadership team is undergoing a major overhaul . CEO Dave Calhoun announced he’s leaving the role at the end of the year, writes Airlines Editor Gordon Smith and Airlines Reporter Meghna Maharishi.

In addition to Calhoun stepping down, Commercial Airplanes Division CEO Stan Deal is retiring while board chair Larry Kellner will not run for re-election. Those senior personnel changes come as Boeing has experienced a rough start to 2024, including a blowout aboard an Alaska Airlines flight in January. Smith and Maharishi note that major airline CEOs and the U.S. government have been increasingly critical of Boeing in recent weeks.

Finally, Booking.com is ending a program that highlighted properties the company believed were standouts in sustainability , writes Executive Editor Dennis Schaal.

Dutch regulators said that Amsterdam-based Booking.com’s “Travel Sustainable” program, which awarded certain properties green leaves as badges, was possibly misleading. Dutch officials said properties might be conducting sustainable practices that weren’t recognized. Booking.com reported last year that more than 100,000 properties on its site had received a Travel Sustainable badge.

  • Injuries During A Paid Travel Time Lunch Break Are Deemed Non-Compensable

Weber Gallagher Simpson Stapleton Fires & Newby LLP

On March 25, 2024, in an unpublished decision, the Superior Court of New Jersey Appellate Division rendered a decision that provided clarity with respect to the analysis of an off-premises lunchtime injury. In Latschaw v. Lakewood Township Police Department , the Court affirmed the denial of the claim by the Workers’ Compensation Judge (WCJ) where the petitioner was injured during the course of an off-premises lunchtime motor vehicle accident despite the fact that she was paid during her lunch break.

The trial of the case consisted only of the testimony of the petitioner since there was no real dispute regarding the facts. The petitioner was an emergency police dispatcher. She was working the 3:00 p.m. to 11:00 p.m. shift and had left the station for her meal break at approximately 6:00 p.m. Pursuant to the Collective Negotiation Agreement between her employer and the Labor Union, the petitioner was paid her salary during her lunch break whether or not she took the lunch break off premises. The petitioner drove her personal vehicle from the station to the restaurant. She did not perform any work-related tasks during her trip. While driving back to the station, she was rear ended by another vehicle causing injuries to her cervical and lumbar spines, as well as her left leg and left ankle.

The petitioner filed a claim for workers’ compensation benefits which was denied by the employer based upon the course and scope of employment defense. Following her testimony and arguments, the WCJ dismissed the petitioner’s claim concluding that she was not in the course of her employment when she was injured because she was on a personal errand.

While this appeal was pending, the Supreme Court issued a unanimous decision in Keim v. Above All Termite and Pest Control , 256 N.J. 47, 55 (2023), which clarified the statutory requirements of N.J.S.A. 34:15-36 that governed compensability of injuries sustained away from the employee’s regular workplace. In that decision, the Supreme Court found the injuries compensable when the petitioner, while driving an employer authorized vehicle, was involved in a motor vehicle accident driving to the employer’s premises in order to load the vehicle with necessary supplies for the day. This Court applied the reasoning of Keim but reached the opposite conclusion in terms of compensability. Significantly, the Court noted once again that conclusions of law such as “course and scope of employment” are fully reviewable by the Appellate Division.

What was enlightening and clarifying in the decision was the approach the Court took to address 4 distinct rules that defined commencement and termination of employment and thus compensability of injuries under Section 36 of the statute. The 4 scenarios to be addressed to determine compensability of an off-premises injury are:

  • The premises rule;
  • The special mission rule;
  • The paid travel time rule; and
  • The authorized vehicle rule.

Applied to this case, the Court only addressed the first 3 scenarios since the petitioner was not in an authorized vehicle.

With respect to the premises rule, Section 36 makes it clear that employment shall terminate when the employee leaves the employer’s place of employment, “excluding areas not under control of the employer”. Applied to this matter, the Court easily rejected this possible compensable scenario since the petitioner was not injured on the premises of the employer or under the control of the employer, but rather on a public street.

Addressing the second scenario, the petitioner was not covered under the special mission rule since at the time of the accident the petitioner was not on a special mission for her employer, but simply pursuing a personal errand in obtaining her meal. The Court noted that had the petitioner been pursuing meals for multiple employees at the direction of her employer, the conclusion would have been a finding of compensability.

The Court noted that the fact pattern in Keim was quite distinct since the petitioner was driving to resupply his pest control vehicle with chemicals from his workplace at the employer’s express direction.

Finally, the Court noted that the petitioner is not covered under the paid travel time rule. The Court noted that this scenario only applies when:

  • The employee’s injury is sustained while going to and from a jobsite separate from the place of employment, and;
  • The employee is paid for the time spent in that travel.

While the petitioner expressed that she was paid for her time on her lunch break that in and of itself did not establish compensability. The paid travel time required the petitioner to be traveling “to and from a jobsite” at the time of the accident. The petitioner was travelling to and from a restaurant and not a job site, thus even though she was paid for the lunch break, the injuries did not take place during the course of her employment. In support of this aspect of the decision, the Court relied upon several cases including injuries sustained during a paid lunch break on premises while the petitioner was playing paddleball. Even though the petitioner was paid, the employer did not contribute to, participate in, or encourage the game. The game had no connection with employment duties.

COMMENT: The decision is certainly an interesting one. Ordinarily, off premises lunch injuries are not compensable. The fact that the petitioner was paid during the course of her lunch whether or not she was on premises could have resulted in a different decision. However, the Court was careful to note that payment alone is insufficient if, at the time of the incident, the petitioner is not furthering her employer’s business interests, on a special mission or driving to/from a job site. Simply being paid while being off premises pursuing a purely personal errand does not amount to a compensable claim.

Editor's note: Call to Earth is a CNN editorial series committed to reporting on the environmental challenges facing our planet, together with the solutions.  Rolex’s Perpetual Planet initiative  has partnered with CNN to drive awareness and education around key sustainability issues and to inspire positive action.

(CNN) —  The largest apex predator in the tropical seas, tiger sharks are notoriously fierce. They can grow to more than six meters (20 feet), have sharp serrated teeth and are second only to great whites in number of reported attacks on people. But in The Bahamas, tiger sharks have taken on a rather less ferocious role, as assistants to marine scientists.

Between 2016 and 2020, a team of researchers fixed tags equipped with cameras onto tiger sharks so that they could view the ocean floor from a new perspective. The data they collected revealed what is the world’s largest known seagrass ecosystem, an area of up to 92,000 square kilometers (35,000 square miles)   in the Bahamas. According to  their study , published in 2022, this extends the total known global seagrass coverage by more than 40%.

This is significant as seagrasses trap and store massive amounts of carbon in the sediment and are therefore a vital tool in mitigating climate change.

Dr. Austin Gallagher, one of the report’s co-authors and founder and CEO of ocean research organization Beneath the Waves, believes that tiger sharks and other marine life can help scientists to map ocean ecosystems and lead to other significant discoveries. As guest editor for Call to Earth, he spoke to CNN about what it’s like collaborating with tiger sharks and the importance of protecting the ocean’s carbon sinks.

Hawaii resident Cindy Poindexter captured video of a shark swimming in shallow waters in Maui, Hawaii. She approached it believing it was a sea turtle when she realized it was actually a shark, “It was so close to the shore we thought it was going to beach itself” she said.

The following interview has been edited for length and clarity.

CNN: When did the idea to put a camera on a tiger shark come about?

We’ve been putting cameras on animals for decades in the scientific community and we’ve been doing that in the field of sharks for many years now. So, it wasn’t completely novel, but we wanted to advance our work on tiger sharks to get a better understanding of what a day in the life of a tiger shark looked like. To do that, we needed to be able to see what the animals were seeing because we can infer all sorts of types of patterns based on their movement: where they go and how much time they spend in certain areas and habitats. When we did that, it opened a whole Pandora’s box of new questions and it eventually put us down a path of radical discovery here in The Bahamas.

CNN: What did you discover from the tiger shark data?

We knew that tiger sharks spend a lot of time over the shallow water carbonate banks here in The Bahamas and we knew that there is an expansive seagrass ecosystem here, but it wasn’t until we got the data back from those camera-equipped tiger sharks that we really saw how important and expansive the seagrass might be. It turned the light bulb on for the first time: that we need to map out how much seagrass is here.

We knew that we had to map it out from space, because while tiger sharks gave us a dozen or so good traces with those camera tags, we had to take Earth-orbiting satellites and a remote-sensing approach to map out how much was there. It would never be possible as humans, or as tiger sharks, to do the entire exclusive economic zone of The Bahamas. So we did that and we were able to map it out. We put divers in the water to validate all the predictions from space, we took pictures ourselves of the sea floor, and we then used more data from tiger sharks, including 360-degree camera tags that gave us a full comprehensive look at what the animals were seeing.

It ended up validating a prediction of up to 93,000 square kilometers (35,000 square miles)   of seagrass ecosystem here in The Bahamas, which makes it by far the largest on Earth. It was hiding in plain sight.

CNN: What more is there to discover?

We’re just at the beginning of understanding how valuable and how important this seagrass asset is, and what role tiger sharks, sea turtles and other threatened biodiversity plays in that relationship. And let’s also not forget about humans and the role that we play in the future of preserving these ecosystems.

Mapping and discovering them is just one part of it. Then it’s creating new protections around them and working with governments and environmental decision makers to really put all these data into the right packages and submit them to the right bodies that will eventually issue things like carbon credits that can be used to leverage protections, but also create financial benefits and ultimately long-term financial returns for places like The Bahamas.

CNN: What is blue carbon and why is it so valuable?

Blue carbon is a term for all the carbon that ends up in the ocean. It happens naturally and it is stored and sequestered in the ocean in its various sediments, largely through plants – things like seagrasses, mangroves, salt marshes. These are what we call blue carbon ecosystems, and through natural processes like photosynthesis, these plants sequester and store massive amounts of carbon – significantly more than their terrestrial counterparts.

If we want to try and create new protections for the ocean, if we want to try and build resiliency, particularly in low-lying countries and small island developing states, we have a real objective to build resilience in the place of climate change. One of the ways that we can do that is by working in partnership with nature: seagrasses, mangroves, they are what we call a nature-based solution to climate change. If we want to try and enhance coastal protection and create benefits for communities and biodiversity, going out and quantifying how much carbon and what the extent of that looks like is incredibly important for ocean research.

CNN: What is the end goal of your scientific research and work?

The ultimate goal of the work that I’m doing is to create empathy for the ocean and to also preserve what we have for future generations. To live harmoniously with these ecosystems, to find ways to live harmoniously with sharks, to protect these ecosystems like seagrass. It’s creating marine protected areas, it’s enhancing existing conservation measures for threatened species like sharks, but it’s about making sure that the legacy of these incredible ecosystems remains as intact as possible for as long as possible.
