Comparing V-1, WX-1, SX-1, and B-1 visas in Canada

Canadian V-1, WX-1, and B-1 visas

Before comparing V-1, WX-1, SX-1, and B-1 visas, let’s explore the documents you need to travel to Canada. Most travellers to Canada must carry a valid passport . Moreover, unless you are exempt from a visa, you must obtain a Temporary Resident Visa ( TRV ) to travel to Canada. A TRV is mandatory for many travellers regardless of their intentions. Consequently, whether you are travelling for pleasure, visiting family members, studying or working in Canada, you must have a valid TRV. Of course, the Border Services Officer has an ultimate say in permitting you to enter Canada.

When you receive a TRV, the immigration authorities affix a counterfoil to your passport. The counterfoil includes a unique code, among other pieces of information. I have another article that lists these codes .

A V-1 category code on a visa counterfoil means you are simply visiting Canada. Moreover, it could mean you do not intend to work or study in Canada. Typical reasons for V-1 visas could be the following:

  • Visiting family members, friends, or acquaintances
  • Meeting your potential partner in Canada
  • Accompanying a family member in Canada who is visiting Canada for the same or other reasons

When filling out the TRV forms, there is no box to pick which category code you need. You explain the reasons for your travel, and then the officer chooses the appropriate code on your behalf. Of course, nowadays, an AI program such as Chinook might do this. As you can imagine, if the code appears differently and instead of V-1 is B-1, WX-1, or SX-1, you have entered a different purpose for your visit.

The B-1 category code covers business visitors . I have another article that explains business visits in Canada in detail. Regardless, business visitors may generally enter limited work or training activities as part of their visit to Canada. Remember, a B-1 category code does not replace a study permit or a work permit . Nonetheless, under the context of doing business, it allows the holder to engage in certain activities that a typical V-1 holder does not do. Before jumping to any conclusions, make sure to read my article on this subject . Also, keep the following in mind:

  • Business visitors visit Canada for international business.
  • A business visitor’s primary source of remuneration must be from outside Canada.
  • Any training or work activities must be due to the nature of their business visit, not a typical educational or employment activity in Canada.
  • Unless the end users are governments or organizations, business visitors may not sell products or services to the end users.

Sometimes you may work in Canada without a permit. Section 186 of the immigration Regulations explains such circumstances. You may apply for a TRV, but mention you will work in Canada under the authority of this section. Therefore, the officer will issue you a WX-1 visa if they approve your application. Most of the jobs under R186 face significant limitations in terms of scope and duration. Here are some examples:

  • An aviation expert that visits a plane crash site for inspection
  • A performing artist that attends a live performance
  • A professional speaker that speaks at an event which is less than five days

Of course, the list covers a lot more activities. I have another article about working in Canada without a permit. Sometimes a WX-1 visa could qualify you to apply for a work permit inside Canada . Furthermore, you could count your work experience for the Canadian Experience Class or other immigration options. However, consult a professional to ensure these options apply to you.

When you receive an SX-1 category visa, you may study in Canada without a permit. Section 188 of the Regulations and subsection 30(2) of the Immigration Act describe situations where you can study in Canada without a permit. Since I have explained those circumstances in a separate article , I won’t repeat myself here. However, remember that most international students must obtain a study permit .

When you enter Canada, a border services officer ( BSO ) decides how long you may stay in our country. However, the default duration of stay is six months [practitioners see R183(2) ]. In the case of a V-1, the officers rarely allow you to remain in Canada for more than six months. However, for B-1 and WX-1 visas, it is more common for them to allow you to stay for more than six months. Of course, you must justify the reasons for remaining in Canada longer than usual. The SX-1 visas are tricky and depend on the nature of the study permit exemptions. For example, if the duration of the study is less than six months, then there is no need for you to remain in Canada for six months or beyond. Moreover, consider the following:

  • The BSO has an ultimate say in how long you may stay in Canada. Nonetheless, if they deviate from the six-month duration, they will likely issue you a Visitor Record .
  • Certain people need an upfront medical examination if they intend to remain in Canada for more than six months. I have explained this matter in another article .
  • While in Canada, you always have the chance to apply for an extension . However, you must apply before the expiry of your current stay. It would help if you also had enough justification for your extended stay in Canada.
  • If you overstay in Canada , you must leave immediately or apply for the Restoration of Status . Unfortunately, if your overstay is more than 90 days , restoration of Status is not an option. You must either leave Canada or apply for a Temporary Resident Permit ( TRP ). Of course, depending on your situation, alternative options such as in-land spousal sponsorship or a permanent resident application under H&C could be available to you. You could face a removal order if you don’t take proper steps.

Let’s say you are a tourist in Canada with a V-1 visa. However, you attend a training program that is under six months and exempt from a study permit. Do you need to switch your V-1 visa to an SX-1? As another example, let’s assume you hold a multiple-entry B-1 visa. You travelled to Canada once as a business visitor. However, you are travelling to Canada for work under the circumstances exempt from a work permit . Do you need to switch your B-1 visa to WX-1?

Let’s look at this from three angles:

  • When you applied for the TRV, you met the requirements of the visa the original officer issued for you.
  • You still meet the requirements.
  • The main concern in any temporary resident application is whether you leave Canada by the end of your authorized stay or not.
  • Voluntary withdrawal
  • Direction to Leave or Direction to Return to the United States
  • A removal order
  • Inadmissibility to Canada for five years

Considering these angles use your judgment to decide if an application for a new type of visa is necessary or not. Of course, you may book a consultation session with me to explore your potential options.

Visitor V-1 category should leave the Canada with in 6 months ?

Hi , I am currently working in Canada on work permit. My wife in India got Canada Visitor V-1 category visa which expires on December 2023. In some forums I have seen that person having visitor visa must leave the country with in six months. Is it true ? In my case my wife visa expires on December 2023 but still is it compulsory that my wife should leave Canada with in six months after her entry to Canada irrespective of her Visa validity date ? Appreciate your help on this. Thanks Hari  

Unless stamped otherwise when you enter Canada, a visitor visa allows someone to visit for six months. At the end of that six months, the person either needs to leave Canada or apply for an extension to their visit (before the visit ends). The expiry date indicates when the visa is no longer valid. It does not mean someone is allowed to remain in Canada for that long without leaving.

When does your passport expire? If your passport expires shortly after you arrive/less than 6 months from 25 August, you can expect the CBSA officer to limit your stay i.e. it will not be 6 months from 25 August

Hi, i am a foreign student in the US and have a temp visitors Canadian visa valid up to 5 years. Can i get a work permit or permanent residency in Canada?

Can a Visitor Work in Canada?

While work and study permits are issued for performing or undertaking specific activities in Canada, a visitor visa has a broader scope. However, that doesn’t mean that there aren’t any restrictions on what you can and cannot do as a visitor in Canada.

Canadian work regulations apply to all individuals who are not Canadian citizens or permanent residents. If you are visiting Canada with a Visitor Visa, there are crucial considerations to keep in mind before seeking employment in the Canadian labor market. That’s why, in this blog, we will provide a clear breakdown of what is permissible and what is not while under a Visitor Visa.

Under a Visitor Visa You Cannot…

1. stay permanently.

A visitor visa allows you to enter Canada and gives you temporary  legal status in the country. However, you only maintain that status for as long as your visa is valid. You cannot legally stay in Canada on a visitor visa that is no longer valid.

2. Work in Canada

You need a valid work permit to work in Canada. A visitor visa does not allow you to work in the country. So, you need to make sure you don’t engage in any commercial activity where you directly enter the labour market of Canada during your stay as a visitor.

3. Study in Canada

As a visitor visa holder, you cannot study in Canada except under the specific conditions listed above. In all other cases, you need a study permit to legally study in Canada.

4. Apply for a study permit

You cannot apply for a study permit from within Canada on the basis of your status as a visitor. You will have to initiate the study visa process after returning to your country. One exception to this rule that allows a visitor to apply for a study permit from within Canada is if he or she has a family member holding a valid Canada study or work permit.

But Under a Visitor Visa You Can…

1. enter and stay in canada.

Firstly, and most importantly, a visitor visa allows you to enter Canada. Once inside Canada, your visitor visa gives you temporary legal status to live or travel anywhere you want in Canada. When visiting Canada and considering it as a potential destination for work or immigration, you have the unique opportunity to compare cities, labor markets, job prospects, cultural experiences, and the best places to live. This firsthand experience allows you to envision what life in Canada could be like if you plan to immigrate in the coming years. Keep in mind, though, that this is a temporary status. Visitor visas can be issued for periods up to six months. The exact validity period of your visa will be determined by the officer who issues the visa. Once the validity period is over, your visa will expire and you will lose your legal status as a visitor in Canada.

2. Search for Work in Canada

While visitor visas are not meant to be used as a vehicle to find work in Canada, visitor visa holders are  not  expressly prohibited from searching for work while they’re in Canada. In fact, Canadian employers often prefer to meet candidates in person before they hire them, so searching for work from inside Canada may be more effective than trying to find a job from overseas. However, if you do choose to search for work while you’re on a visitor visa, you should keep the following in mind:

  • Never conceal or falsify your reason for visiting Canada from an immigration officer.
  • You will be expected to prove your intention to return to your country when your visitor visa expires irrespective of the outcome of your search for work.
  • You will be expected to prove that you won’t work in Canada without a valid work permit.

3. Join a short-term course in Canada

Normally, you must obtain a study permit to be eligible to study in Canada. However, there are some rare exceptions that allow you to study in Canada on a visitor visa if you meet the following conditions:

  • The school offering the course is  not  a Designated Learning Institute (DLI).
  • The duration of the course or program is less than six months.
  • The course is not a part of a longer program.
  • You will complete the course before the expiry of your visitor visa.

4. Apply to extend your stay in Canada

Visitor visas can be issued for a period of up to six months. However, if you would like to extend your stay beyond the initial validity period of your visa, you can apply for an extension. Whether or not the extension is issued, and the validity period of the extension, are at the discretion of the immigration officer reviewing your application.

5. Perform business activities

While you generally need a work permit to work in Canada, you can carry out some business activities while on a visitor visa, as long as you do not directly enter the Canadian labor market. For example, you can:

  • Purchase goods or services for a foreign business from Canadian businesses.
  • Visit a business site.
  • Receive training for product use, sales or other business functions under invitation from a Canadian business.
  • Meet and interact with people for initiating and concluding a business transaction.

6. Apply for a work permit

Usually, visitors do not have the right to apply for a work permit while in Canada. However a temporary measure valid until the end of February 2025, makes it possible for visitors who receive a valid job offer while in Canada to apply to get a work permit while in Canada on a visitor visa.

Prior to this temporary policy change, those applying to work in Canada would typically need to apply for their initial work permit before they came to Canada. If they were already in Canada with visitor status when they were approved for a work permit, they would need to leave Canada to be issued their work permit. With this policy in place, leaving Canada isn’t necessary.

Yes, it is possible. Foreign visitors in Canada with valid job offers can now apply for work permits without having to leave, thanks to a temporary policy extension until February 28, 2025.

Steps to Convert Visitor Visa to Work Permit

  • Temporary Policy Extension:   If you’re currently in Canada as a visitor and have received a valid job offer, you can apply for a work permit without leaving the country.
  • Eligibility Criteria : You must have valid visitor status, a job offer supported by LMIA or an LMIA-exempt offer, and apply for an employer-specific work permit by February 28, 2025 .
  • Conversion Steps : Apply for a Visitor Visa in Canada, consider requirements and fees, apply with necessary documentation, secure an LMIA-supported job offer, explore alternative pathways without LMIA (if needed), and apply for a work permit from within Canada.
  • Post-Temporary Policy – Flagpoling : After the policy expires, individuals may need to go through a flagpole, a process involving exiting Canada through the US border, applying for a work permit, and re-entering Canada.
  • Interim Authorization to Work : You can request interim authorization to work while waiting for your work permit approval.

What is Interim Work Authorization?

If you’re applying for a job in Canada and have recently visited there with a valid work permit, you can follow some special instructions to get an interim work authorization. This will allow you to start working for your new employer before your work permit is finalized.

To be eligible to apply, an applicant must:

  • Have valid status in Canada as a visitor on the day they apply.
  • Have a job offer supported by a labour market impact assessment (LMIA) or an LMIA-exempt offer.
  • Apply for an employer-specific work permit no later than February 28, 2025.
  • Meet all other standard admissibility criteria.

1. Apply for a Visitor Visa (TRV)

The first logical step to convert visitor visa to work permit in Canada is to become a Canadian visitor. You need to understand the following requirements before applying for a visitor visa (Temporary Resident Visa – TRV) for Canada.

Visitor Visa Fees and Requirements

  • The application fee for a visitor visa is $100 CAD (~ 5,200 INR), while the biometrics charge is $85 CAD (~ 4,400 INR).
  • A cost of $100 CAD per person is required to extend your visitor visa.
  • You must pay a visa cost of $200 CAD (About 11065.45 INR) to regain your tourist status.
  • Prove that you will leave the country after your visit.
  • Prove that you have sufficient funds to maintain yourself and any accompanying family members while in Canada.
  • Be in good health and be willing to conduct a medical exam if required.
  • Not have any criminal record; be willing to get a police verification done.
  • Be able to provide all supporting documents at the request of the visa officer.

Canada Visitor Visa Processing Times

TRV applications are generally processed within 30 days . However, this can vary based on factors like application type, applicant’s country, and application backlog. Always check the latest processing times on the official IRCC website. Remember, complete and accurate documentation can help avoid delays. Consult an immigration expert if needed.

Application Process for a Visitor Visa

  • Decide whether you want to apply online or in person.
  • Complete a visa application form with all of the necessary information and papers.
  • Make a certified check or bank draught payment for the visa processing cost.
  • Bring your passport, photos, and other documents to the nearest Canadian visa application center.
  • You must provide your fingerprints and a photograph (biometrics)
  • Go to the Canada visa application center and submit your visa application form.
  • Get a receipt from the application center with your unique tracking number on it.
  • Use this number to track your application online.

2. Getting a Job Offer and a LMIA

After you enter Canada, you have limited time to apply for a job and get a positive LMIA. Not to mention, getting a job offer is an extremely difficult process in itself. So it is better that you do your homework properly. Let’s explain this point in detail.

Research for the Job

  • Understand the labour market opportunities in your destination.
  • Match your NOC code with the in-demand jobs in that area.
  • Apply for Jobs online through Indeed, LinkedIn, Glassdoor, etc.
  • Apply directly to the employer’s website.
  • Friends and family can help to find employment opportunities.

Get a Positive LMIA

Even after enough job research, there are high chances that you won’t be able to get a job offer from a Canadian employer. Because an employer has to fulfill the LMIA Requirements to hire you, and not many employers are willing to sponsor temporary visitors.

Factors to improve your chances to get a work permit while on a visitor visa:

  • You have exceptional skills that employers won’t find anywhere else.
  • You have enough contacts to support you in Canada.
  • You have hired someone to search for a suitable job for you.

Visitor Visa to Work Permit (without LMIA)

You can get an open work permit without LMIA only:

  • If your spouse / common-law partner has a study permit and is studying in a DLI, you can apply for an open work permit as a temporary visitor.
  • If your spouse / common-law partner has a work permit and is working in occupations specified in NOC 0, A, and B, you can apply for a work permit as a visitor visa holder.
  • If your spouse / common-law partner is waiting for PR and has “ approval in principal ” status, you may apply for a work permit as a visitor.
  • If you have applied for PR under Spousal Sponsorship, then you can apply for a work permit while you’re waiting for the decision.

3. Converting Visitor Visa to Work Permit in Canada

New temporary policy.

After you get a positive LMIA from a Canadian employer, you can apply for a work permit from inside Canada. On February 28, 2023 , IRCC announced that foreign nationals currently in Canada on a visitor visa and who have a valid job offer would continue to be able to apply for and receive a work permit without having to leave the country. The temporary public policy has been extended by two years until February 28, 2025.

What is Flagpoling?

After the temporary policy expires, you have to go through a process called Flagpoling . In this temporary, visitors must go out of Canada through the US border, apply for a work permit, and then re-enter Canada.

Using the flagpole process to activate a new Canadian work permit is legal. However, it is important to be truthful and provide accurate information during the process. Giving false information can lead to serious consequences. Please consult an immigration expert before attempting to flagpole or change your immigration status.

4. Interim Authorization to Work

We have discussed how to convert a visitor visa to a work permit in Canada. Now, let’s understand how Interim Work Authorization works. If you apply for a work permit in Canada while under visitor status, you must wait approximately 135 days to receive it. This means that you cannot work until your work permit is approved.

IRCC addressed this problem through an “ Interim Authorization to Work .” With that, you can obtain this authorization to work quickly. You can start working immediately if you have received an employer-specific job offer . It was introduced to address labour shortages, though it is not automatic.

The process for Interim Authorization to Work is as follows:

  • Fill out this IRCC web form , which is available on the official website.
  • Wait for IRCC to contact you. This may take up to 30 business days (6 weeks).

I have a visitor visa. Can I leave Canada and come back?

The visitor visa is officially called a temporary resident visa.  There are 2 types of visas: single-entry visa and multiple-entry visa.

If you have a single-entry visitor visa

  • In most cases, you’ll need a new visa if you want to leave and come back to Canada
  • you’ll only visit the U.S. or St. Pierre and Miquelon; and
  • you’ll return to Canada before the end of your approved stay in Canada.

If you have a multiple-entry visitor visa

  • You can leave and come back to Canada multiple times as long as your visitor visa has not expired.

If you have an expired visitor visa

  • you’ll  only  visit the U.S. or St. Pierre and Miquelon, and
  • you’ll return to Canada  before  the end of your approved stay in Canada.

Before travelling back to Canada

You must meet all the necessary requirements, including all testing and quarantine requirements. A border services officer will make the final decision at the port of entry.

Foreign students and workers who got a temporary resident (visitor) visa in Canada

If there is a V-1 code on your visitor visa

This is not an error. Due to COVID-19, we have temporary measures in place to process visitor visa applications submitted from inside Canada.

  • Foreign students and workers who applied for a visitor visa in Canada since July 2021 may get a V-1 visitor visa.
  • You can use your V-1 visa to leave and re-enter Canada – the same way you would use your S-1 or W-1 visa.
  • You don’t need to request a different type of visa or follow up with the processing office or client support centre. A new visa will not be issued in this case.

Validity period is different on the V-1 visa

  • This is part of the temporary measures in place that will be in effect until further notice.
  • If your V-1 visa expires , you can apply for a new visitor visa .

The visa exemption for citizens of Australia, Canada, and the United States who wish to visit Brazil has been extended to April 10, 2025. 1  Decree No. 11,982 was published on Tuesday, April 9, in an extra edition of the Official Gazette of the Union ( Diário Oficial da União ). 2

WHY THIS MATTERS

The postponement of the start of visa collection aims to foster the complete implementation of the electronic visa, called “e-Visa,” available at the electronic address: https://brazil.vfsevisa.com . 

The new way of requesting the document makes it practical and convenient to issue the document completely electronically, eliminating the need for the interested party to appear at a Brazilian consulate. 

The document requirement will be effective from April 10 of next year.  

More Details

The Lula government's decision to require visas for the United States, Canada, and Australia should have come into force on October 1, 2023.  (For prior coverage, see GMS Flash Alert 2024-006 , January 10, 2024.)

But after pressure and problems regarding serving tourists from these countries, the deadline was postponed to January 10.  Afterwards, the deadline was once again postponed to April 10.

The decision does not apply to Japan, as the Japanese government announced, in May 2023, that it was evaluating removing the visa requirement for Brazilians and confirmed the decision in August 2023, with validity from September 30, but for travel for up to 90 days.  In return, Brazil stopped requiring visas for Japanese nationals.

KPMG INSIGHTS

This situation has been in flux for some time, creating uncertainty for the affected parties.  At present, the status quo remains; however, travel agents and immigration counsel should be prepared for the change in requirements that will take place in April 2025.

Some Brazilian consulates abroad, including the one in Houston 3 , have already begun advertising the e-visa and its necessary requirements on their websites. This means that immigrants who have already obtained an e-visa will not face any consequences when presenting it to Brazilian immigration authorities. The e-visa is valid for 10 years, so those who have already obtained it will not be negatively affected by obtaining it early. Next year, the e-visa requirement will be fully implemented and mandatory. However, those who have already obtained it before it becomes mandatory will have an advantage as they will already possess an entry permit.

Individuals with intent to travel to Brazil who are from the aforementioned countries should consult with their travel agent and qualified immigration counsel or a member of the KPMG mobility team (see the Contacts section).
