In break from Tennessee Senate, House franchise tax bill would require public disclosure
A new House version of a costly plan to change the Tennessee's franchise tax system would require the state to publicly list the businesses receiving refunds, an effort to inject some transparency into a process muddied by state officials' refusal to release records justifying the overhaul.
House Majority Leader William Lamberth, R-Portland, filed the amendment to HB 1893 , which received first passage out of a House subcommittee on Wednesday. The House version contains significant differences from the Senate's $1.9 billion plan, which upper chamber Republicans passed last week.
The House version would cost around $800 million, which Lamberth called "significant savings" for the state, split between a $400 million cost in the upcoming fiscal year and around $400 million in subsequent years. Companies who take a rebate from the state would also have to waive their right to sue over the franchise tax in the future, as lawmakers have argued they're pushing this legislation under the spectre of a potential lawsuit.
The franchise tax effort would alter the calculation the state uses to determine business franchise tax, eliminating a property tax calculation, which will cost the state $400 million in revenue beginning this year. The Senate version allows businesses to claim up to three years of tax rebates for previous franchise tax bills, while the House version only covers one year.
Lamberth's version would also create a specific carve-out to existing tax privacy law, which requires confidentiality for state tax information, to allow the state to reveal who is receiving a refund and how much they're getting.

"If a company is asking for a rebate, and that's money they're getting from the General Fund, then taxpayers should know who and how much," Lamberth said.
Senate Republicans last week batted down an amendment from Sen. Heidi Campbell, D-Nashville, to disclose the businesses that benefit from a refund, arguing it would contradict state law requiring tax refund confidentiality. Campbell's amendment sought to make public any "record, document, or other information pertaining to a refund of franchise tax."
Lamberth said publishing the name and dollar amount could satisfy transparency concerns while keeping broader tax records and documentation private.
The House amendment would also require a company to use any Tennessee economic and development credits to "offset and reduce" their franchise tax refund.
The franchise tax break sailed through the Senate last week , where 16 of the 25 Republican senators present declared a Rule 13 personal interest before voting in favor of the bill. One Democrat, who voted against the bill, also declared a personal interest.
Senate Finance Chair Bo Watson, R-Hixson, said Thursday "nobody likes this solution," a familiar refrain from Republicans who have backed the legislation and argued the tax refund, and its gigantic price tag, is the best path forward to avoid expensive litigation.
Yet, no lawsuit has been filed, and there is no court order demanding Tennessee make these changes. Instead, lawmakers have continually touted a letter from a national law firm as the basis for the legislation.
State officials have refused to disclose the law firm's communication with the state, despite public records requests from The Tennessean. Officials have cited attorney-client privilege and the state law that makes tax information confidential. The Department of Revenue declined to release a redacted version of the law firm's letter.
Lamberth on Wednesday expressed skepticism about the legal issues with the existing franchise tax framework, but said he recognized Tennessee is "out of step" with most other states regarding the franchise tax policy."

Just wanted to let you know that My grandson Bruno and I couldn´t have been more pleased with our week in Moscow (6/15 - 6/21). We were absolutely enchanted with the whole experience, including getting lost a couple of times in the Metro during our free time. Although both our guides (both Eleanas) were excellent, I would particularly commend the first one (she took us to the Tatiakov, the KGB tour, and to that beautiful cemetery where so many great Russian artists, authors, composers, musicians, militarists, and politicians are buried). Her knowledge is encyclopedic; and her understanding of today´s Russia as a product of its past was, for us, truly enlightening. Do they speak English in Moscow?
As Russia’s capital city, tourists are well accommodated in Moscow. There should be English-speaking staff in restaurants, bars, hotels, shops and attractions in tourist hotspots, and there are also English-speaking tourist police. Transport services have English translations on their maps and English announcements via intercom; alternatively, order taxis from the Yandex Taxi app (Russian Uber), though it’s unlikely that your taxi driver will speak English. If you get stuck and cannot communicate, it’s fine to use Google Translate.
Is it safe to travel to Moscow?
It is no less safe to travel to Moscow than to any European city if you exercise common sense and look after your belongings. As with every city some regions can be more unsavoury than others, but no tourist attractions are located there. The traffic in Moscow is notorious, so exercise caution when crossing roads. Do not take unlicensed taxis; book in advance or take public transport, which is widespread and perfectly safe. If you encounter any problems, look for the special tourist police who can help you. Tennessee Gov. Bill Lee opposes franchise tax transparency measure backed by House GOP
Tennessee Gov. Bill Lee opposes a House Republican effort to enact a transparency clause in pending legislation that would administer a massive franchise tax refund in the state.
The House and Senate are currently at odds over the legislation . Each chamber passed its version of the bill in recent weeks and will hammer out their differences in conference committee within the next few days.
The House version would allow businesses to seek a one-year refund of a franchise tax some state officials say must be handed out to avoid a costly lawsuit. The House's plan would also require the state to publicly list businesses who benefit from the refund.
Lee on Monday said a public list of companies would be "unprecedented," rare public comments from a governor who typically sidesteps specific questions on pending legislation as it makes it way through the General Assembly.
Meanwhile, House Speaker Cameron Sexton, R-Crossville, said last week their transparency clause is "non-negotiable" for the House as it enters into talks with the Senate.
"I can't speak to how they will determine the final version, but I think that we shouldn't be taking private information of individual or companies tax information that the government has and making it public," Lee said. "Private information should not be exposed to the public."
House leaders disagree that their version would expose private tax information, but House lawmakers have said Tennessee taxpayers have a right to know the company name and total tax refund received. All other tax information would remain private.
Under the House plan, companies who take a refund from the state would also have to waive their right to sue over the franchise tax in the future, as lawmakers have argued they're pushing this legislation under the specter of a potential lawsuit.
Sexton indicated this will also be a non-negotiable for the House as it enters conference negotiations.
The House version is a one-year look back, which would stand to save Tennessee money compared to the Senate's three-year look back, expected to cost Tennessee $1.5 billion in refunds and $400 million in ongoing tax breaks.
Democrats remain critical of the legislation and the justification behind it as Republicans have argued Tennessee must restructure the franchise tax to avoid a lawsuit.
The Lee administration initially proposed the bill, and GOP lawmakers have continually raised the prospect of litigation as justification to make the change. Republican lawmakers have said they're acting on the advice of Attorney General Jonathan Skrmetti, even as the oft-cited legal threat has been kept secret regarding which companies have pushed for the tax change.
In March, 16 of 25 Republican Senators declared a Rule 13 personal interest before voting for it, while Lee has taken criticism for potential benefits to his private company. Lee has said he is unaware of whether the company could benefit, citing a blind trust that was initiated prior to his taking office. One Democrat, who voted against the bill, also declared a Rule 13 personal interest.

Lee on Monday said the change is needed to maintain an "attractive" tax environment for companies looking to invest in Tennessee.
"We have some of the largest companies in the world making decisions to invest here, and part of that is our tax structure," Lee said. "We're trying to maintain that tax environment that mkakes us one of the best states to do business."

Civil liberties groups are raising alarms about a bill making its way through Congress that applies pressure for a ban on travel to Iran for Americans using U.S. passports. The rights groups see the bill as part of a growing attempt to control the travel of American citizens and bar Iranian Americans in particular from maintaining connections with friends and loved ones inside Iran.

“This bill is very concerning because it’s the beginning of a process of criminalizing something that is very normal for many people, which is traveling to Iran,” said Ryan Costello, policy director at the National Iranian American Council. “If you’re an American citizen, the government should not be controlling where you can travel.”
Along with a flurry of other sanctions bills targeting Iran, the bill calling for the travel restrictions passed the U.S. House last week. The bill is now slated to come before the Senate Foreign Relations Committee.
Introduced last fall, the No Paydays for Hostage-Takers Act languished until tensions between Iran and Israel escalated into a series of reciprocal attacks earlier this month.
Among other provisions, the bill seeks to bar U.S. passport holders from traveling to Iran by rendering their passports invalid for such travel. Though the prohibition would need to be enacted by the State Department, the legislative proposal effectively encourages the move and, as with other sanctions against Iran, waiving the authority to enact the ban could incur political costs.
If Donald Trump wins a second White House term, a distinct possibility according to polls, the invocation of the travel ban would be likely. In his first term, Trump imposed the so-called Muslim ban on travel to the U.S. for Iranians, among other nationalities, and has promised to reimpose it if elected again .
The idea of banning travel to Iran on American passports was raised last September by former Trump State Department official Elliott Abrams, a right-wing hawk with a controversial history that includes covering up a Central American massacre and involvement in the Iran–Contra scandal.

In practice, many Iranian Americans tend to travel to Iran on Iranian passports, but Americans of Iranian extraction who do not hold Islamic Republic travel documents would be unable to travel there under the ban. The measure is viewed as a potential signal of deeper isolation for the Iranian people and severing of people-to-people ties between Iran and the U.S.
Iran and North Korea?
The bill, originally proposed last October by Reps. Joe Wilson, R-S.C., and Jared Moskowitz, D-Fla., was promoted as a measure to restrict the Iranian government’s ability to take U.S. citizens hostage as bargaining chips for bilateral negotiations. Some dual-nationals have been arrested in Iran in the past amid tensions between the two countries.
Yet hundreds of thousands of dual-nationals are believed to travel regularly to Iran from across the West. Measures barring their ability to do so would represent an unprecedented step, making it difficult or impossible for people with ties in both countries to visit family or maintain personal and professional connections.

Invalidating U.S. passports for travel to Iran would put it on par with North Korea, which had a similar ban put in place in 2017 — during Trump’s first term — when an American citizen died after 17 months of detention there.
Despite being heavily sanctioned over foreign policy and human rights issues, Iran still has relations with much of the international community and large number of Iranians live throughout the United States, Canada, Europe, and the Middle East.
“North Korea and Iran are very different countries.”
“North Korea is really the model for this policy, as it is the only country where there is such a strict prohibition for travel on the books,” said Costello. “But North Korea and Iran are very different countries. The level of isolation of North Korea is far greater, and it doesn’t have the same diaspora that Iran does.”
This week, a delegation from North Korea traveled to Iran, with reported hopes of breaking North Korea’s total diplomatic isolation as conflicts in the Middle East and Ukraine forge new geopolitics.
Costello said that NIAC is still hoping that the Senate will not approve the bill when it comes to its consideration. Still, the implications of it coming under consideration, alongside Trump’s promises to revive his “Muslim ban” policy, bode poorly for the future of U.S.–Iran relations.
“You are talking,” he said, “about a policy that could affect hundreds of thousands of people.”
