US Attorney General Garland Makes Surprise ICC Visit

THE HAGUE (Reuters) - U.S. Attorney General Merrick Garland made an unannounced visit to the International Criminal Court on Monday and met its top prosecutor, a sign of Washington's shifting policy toward the world's permanent war crimes tribunal.
The United States in not a member of the court, along with major powers including China and Russia, and it imposed sanctions against top ICC officials under the Trump administration.
But under U.S. President Joe Biden those sanctions were lifted and Washington supported the ICC's work in investigating war crimes in Ukraine since Russia invaded in February of 2022.
The ICC said on Twitter that Garland had met with top prosecutor Karim Khan, but it did not provide any details about the meetings. The visit had not been announced ahead of time and no information was provided to the media.

Garland's meeting with top court officials is proof of the improved relationship between Washington and the court, which in March issued an arrest warrant against Russian President Vladimir Putin accusing him of the war crime of illegally deporting hundreds of children from Ukraine.
Biden has said that the ICC warrant was justified.

Moscow has repeatedly denied accusations that its forces have committed atrocities and the Kremlin branded the court decision to issue a warrant for Putin as "null and void."
Not everyone in the current U.S. administration has embraced warmer ties with the ICC.
Last month, U.S. lawmakers said the State and Justice departments were cooperating with the court, but accused
the Pentagon of undermining the war crimes prosecution of Russian officials by blocking the sharing of U.S. military intelligence.

How to visit the International Criminal Court to see a ICC trial

I always assumed that you had to know someone or be involved with the United Nations to visit the International Criminal Court, but visiting the ICC is surprisingly easy. This post will discuss a bit of the history behind the International Criminal Court, things to know before you visit the International Criminal Court, and a bit of my experience attending a trial.

The history of the International Criminal Court
The idea of the ICC has been around for quite some time and although there have been earlier attempts at establishing an international criminal court for war crimes (in relation to the Franco-Prussian War), it took many more years to come to fruition. In 1948, the United Nations adopted the Convention on the Prevention and Punishment of the Crime on Genocide, which set forth the beginnings of the ICC in relation to genocide crimes.
In the 1990s, genocide in the Balkans and Rwanda resulted in the UN Security Council establishing two temporary tribunals to hold people accountable for genocide with the intention of creating a permanent tribunal. In 1998, the Rome conference finalized the establishment of the ICC. (My home country of the United States voted against it along with a few other countries, including Iraq and China.)
Finally, in 2002, the International Criminal Court was established. Today the court hears cases related to war crimes, genocide, crimes of aggression, and crimes against humanity. Victims are part of the court procedure and have a voice at the hearing itself.
It’s not to say that the ICC is not controversial. It certainly is and the court has been accused of bias, a racist agenda in regards to African countries, and slow speed. The United States in particular claims that there aren’t enough checks and balances and refuses to allow ICC judges/prosecutors to enter the United States partially due to the speculation that the ICC will go after American serviceman or government employees.
Things to know before you visit the International Criminal Court
I came into the experience of visiting the ICC a bit surprised that I could even attend a court session at the International Criminal Court. I was there during a session regarding Uganda when a witness was questioned by both sides. Like any courtroom, it will not be the most exciting parts 100% of the time, but it was interesting to watch. I read up on the case online beforehand, which made the session more interesting.
I had only seen the ICC in movies, so it was nice to see the real life version of it. People are less dramatic and even the defense lawyer made a joke at the beginning of the proceedings. It was interesting to see the court work. I was impressed with the safeguards for the individual’s identities and how victims even get to question witnesses. I also browsed the exhibition, which was a bit underwhelming. My favorite part was the “game” where you serve as an investigator to find out how the ICC does its investigations.
Getting to the ICC
The ICC is located at Oude Waalsdorperweg 10, which is a bit outside of the city center of the Hague. I’d recommend renting a bike at Den Haag Centraal or taking the bus. (There are bike and car parking at the ICC.)
It is free to visit the ICC between 9am and 5:30pm Monday through Friday. You do not need to reserve ahead, unless you’re coming with a larger group (more than 9).
Check the court schedule beforehand
If you’re intending to visit the International Criminal Court on a day with a trial, you need to check the court schedule on the website. Court sessions are not every day and this doesn’t require that much planning as the dates are generally announced at least a few months in advance. It’s still possible to visit the ICC on a non-court session day, but I wouldn’t recommend it.
Dress professionally
One of the conditions is dressing appropriately for a courtroom. Most people dress quite professionally, so definitely bring some nicer clothes with you for the ICC. (Personally, I went with a nice pair of jeans, boots, a nice top, and a sweater. ) You cannot wear shirts with anything controversial on them!
Arrive 10-15 minutes early
Security will take some time as there are two levels of security that you must pass through in order to attend a court session. You’ll need to first go to the visitor’s entrance to present your passport or identification. (They will verify that you are 16+).
You’ll get a visitor tag to wear. From here, you’ll pass through security prior to entering the main building where you’ll find lockers/toilets on the left. You’ll need to lock up your items prior to passing through a more intense security check prior to entering a separate public viewing area. You’re not allowed to do a number of things in here, including use a phone, read, sleep, or be disruptive.
You must understand English or French
Court proceedings are in one of the two locations of the court: English or French. Staff generally defaulted to English when I was there and proceedings were translated into English when I was there, but apparently French is sometimes used.
Private sessions are part of the experience
Hearings at the ICC are generally open to the public and around 75 people can fit in the public session. It was far from full at the session that I attended beyond one large schoolgroup. If a witness is testifying in front of the ICC, they are directly underneath the audience platform, so they are not viewable by the public. Similarly, their face is hidden.
Generally, identities beyond the person in question are hidden, so witnesses are asked to avoid any names or identifying information. At various points, your headset will be muted as the court goes into a private session when the victim can discuss identifying information. You can’t hear anything, but you’ll see people below you. It depends on the case, but the ICC aims for most of the hearings to be public.
Your personal items, including phone, will be locked up
You are not allowed to bring much in. You’ll need to put your phone as well as electronics into the clear lockers meant for the public. They’re free to use, but if you expect an urgent call, don’t visit the ICC. 😉
No photos allowed
This is simple, but they do not allowed photos within the building. The view from the 7th floor over the Hague was quite nice, but alas, I didn’t have a phone.
The coffee is actually pretty good (and cheap!)
There’s a small cafe at the International Criminal Court where you can get coffee and snacks. Similarly, you’ll find an ATM and vending machines as there aren’t too many options for food near the ICC. You can pay with a card. I got a soy latte and it was actually quite good and inexpensive.

Thanks for the info. Just wondering (as well as wandering), are there tourist/travel type guides who capfuls help a group of 6 of us to learn about history and processes of the Criminal Court? Perhaps someone from their information department? I’m a Florida Judge (semi-retired) and looking for a more thoughtful experience. Many thanks for a reply.

Hi Emanuel, You should contact the ICC themselves. If you’re a group, they might be able to organize something special if you email them. I haven’t had that experience, but I met someone able to set up a group tour.

Chief Prosecutor of the International Criminal Court (ICC) Karim A.A. Khan concluded his trip to Israel and Palestine on Sunday, issuing a statement stressing the importance of international law. This was the first visit to Israel and Palestine by an ICC prosecutor.
Khan made the trip after families of October 7 attack victims asked the ICC to investigate possible war crimes and genocide committed by Hamas against Israeli civilians. Palestinian rights groups, and five countries, filed their own referrals to the ICC saying Israel was committing war crimes and genocide. Khan spoke with the families who requested his visit and toured “scenes of calculated cruelty” in southern Israel. He also met with Palestinian authorities like President Mahmoud Abbas, Prime Minister Mohammad Shtayeh and Minister of Justice Mohammad Shalaldeh.
A number of Palestinian rights groups refused to meet with Khan, accusing him of prioritizing Israeli claims over longstanding Palestinian complaints. “As Palestinian human rights organizations, we decided not to meet him,” said Ammar Al-Dwaik, director general of the Independent Commission for Human Rights, Palestine’s national human rights institution. “I think the way this visit has been handled shows that Mr Khan is not handling his work in an independent and professional manner.”
Khan expressed outrage about Hamas’s attacks on Israeli civilians, the taking of hostages to Gaza, escalating settler violence in the West Bank, civilian casualties and attacks on civilian infrastructure in Gaza and Gaza’s acute need for humanitarian aid. He said that his office was committed to a thorough investigation of possible crimes under the Rome Statute and that international law should protect everyone. “During this mission,” Khan said, “I had a simple message: my Office is here to ensure that the protection of the law is felt by all.”
The ICC prosecutes the most serious international crimes. The Rome Statute is the document that governs the ICC and gives it jurisdiction over cases of war crimes, genocide, crimes against humanity and crimes of aggression. The State of Palestine is a party to the Rome Statute and the ICC; Israel is not.
Accusations of war crimes and genocide are at the center of the complaints filed with the ICC. Article 8 of the Rome Statute defines war crimes as violations of the Geneva Conventions or other international law. It lists examples including hostage taking, the targeting of civilians, the targeting of civilian infrastructure and attacking medical or humanitarian facilities and personnel. Article 6 of the Rome Statute, echoing the Convention on the Prevention and Punishment of the Crime of Genocide , defines genocide as any acts committed “with intent to destroy, in whole or in part, a national, ethnical, racial or religious group.” These acts can include:
(a) Killing members of the group; (b) Causing serious bodily or mental harm to members of the group; (c) Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part; (d) Imposing measures intended to prevent births within the group; or (e) Forcibly transferring children of the group to another group.
International law experts have said that Hamas’s initial attacks killing 1,200 people, mostly civilians, the taking of hostages and rocket attacks targeting civilian areas constitute war crimes. The families that invited Khan also say that the Hamas attacks were an act of genocide. Human rights groups have accused Israel of war crimes over its response, which has killed more than 15,000 people in Gaza—again, mostly civilians. They point to attacks on places like medical facilities and refugee camps, the high number of journalist deaths and restrictions on humanitarian aid, food, water and fuel. Palestinian rights groups and President Mahmoud Abbas contend that Israel’s actions amount to genocide. International law and genocide scholars have expressed similar worries.
Khan’s visit comes nearly two months into Israel’s war with Hamas and shortly after a temporary ceasefire that resulted in the release of numerous hostages and an influx of humanitarian aid. With Israel and Hamas returning to hostilities, Khan said adherence to international law should be paramount. He specifically mentioned that Israel “has trained lawyers who advise commanders and a robust system intended to ensure compliance with international humanitarian law,” imploring them to prioritize such compliance. Khan described this visit as only the beginning, saying his office was committed to conducting comprehensive investigations in the region.

On March 16, 2006, the United Nations General Assembly established the UN Human Rights Council (UNHRC) to replace the UN Council on Human Rights. The UNHRC was created by the overwhelming passage of Resolution A/RES/60/251ly .

The ICC is located at Oude Waalsdorperweg 10, which is a bit outside of the city center of the Hague. I'd recommend renting a bike at Den Haag Centraal or taking the bus. (There are bike and car parking at the ICC.) It is free to visit the ICC between 9am and 5:30pm Monday through Friday.
