E-commerce & Privacy

The Website  www.beachcomber.co.za  sells Mauritius holiday packages online.  The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website. 

The private information required for executing the package/s placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Only the necessary information, that is the delivery address and contact phone number will be made known to third parties delivering the product.  Credit card details are not kept by the Provider under any circumstances.

The Provider cannot be held responsible for security breaches occurring on the User’s electronic device (Personal Computer or other electronic device used to browse the Website), which may result due to the lack of adequate virus protection software or spyware that the User may inadvertently have installed on his/her device.

Online Payment - Wirecard Payment Gateway

All online credit card payments are processed by the Wirecard  Internet Payment Gateway .  Card Holders may go to  www.wirecard.co.za  to view Wirecard security policy.

Updating of these Terms and Conditions

Provider reserves the rights to change, modify, add or remove from portions or the whole of these Terms and Conditions from time to time. Changes to these Terms and Conditions will become effective upon such changes being posted to this Website. It is the User’s obligation to periodically check these Terms and Conditions at the Website for changes or updates. The User’s continued use of this Website following the posting of changes or updates will be considered notice of the User’s acceptance to abide by and be bound by these Terms and Conditions, including such changes or updates.

Limitation of liability

The Website and all Content on the Website, including any current or future offer of products or services, are provided on an “as is” basis, and may include inaccuracies or typographical errors. The Owners make no warranty or representation as to the availability, accuracy or completeness of the Content. Neither Provider nor any holding company, affiliate or subsidiary of Provider, shall be held responsible for any direct or indirect special, consequential or other damage of any kind whatsoever suffered or incurred, related to the use of, or the inability to access or use the Content or the Website or any functionality thereof, or of any linked website, even if Provider is expressly advised thereof. While every effort will be made to keep all information on this website updated at all times, any information or part thereof on this website is subject to change without prior notice due to contractual changes coming into effect.

Privacy: casual surfing

The User may visit the Website without providing any personal information. The Website servers will in such instances collect the IP address of the User computer, but not the email address or any other distinguishing information. This information is aggregated to measure the number of visits, average time spent at the Website, pages viewed, etc. Provider uses this information to determine use of the Website, and to improve Content thereon. Provider assumes no obligation to protect this information, and may copy, distribute or otherwise use such information without limitation.

COVID-19 LAND AND AIR CANCELLATION POLICY

Policy applicable to new bookings from 15 June 2020, excluding Villas at Le Morne. Terms and conditions apply.

LAND PORTION: Beachcomber Tours will not charge any cancellation/penalty fees due to travel bans or travel restrictions out of a client’s control, and all bookings will be 100% refundable. (Excluding any fee a travel agent may charge for their time and service.)

AIR PORTION: Airlines have different rules and policies. Airlines are not offering refunds, but are permitting clients to change their travel dates.

For Mauritian residents

Preferential rate applicable on presentation of your Mauritian Identity card or Residence permit. While we strive to always provide the latest information and details about our product offerings on this website, please be sure to check with the hotel on any specifics that may be important to you. Information presented here is subject to change.

Beachcomber carries out regular improvements to its existing accommodation and therefore room facilities or room layout of the reserved room may be different from the displayed photo.

Night-time: elegant (shirt and trousers mandatory for gentlemen)

Beachcomber Resorts & Hotels does not offer pet friendly facilities.

  • Check-in: 2 p.m.
  • Check-out: noon
  • For an early check-in or late check-out after 6.00 p.m., one full night will be charged.
  • Rate charged will be based on meal plan booked and offers.

For a late check-out until 6.00 p.m. (on request), 50% of the applicable rate will be charged – except for Royal Palm Beachcomber Luxury, where one full night will be charged for a pre-bookings and late check-outs.

For nights falling between 20 December 2023 and 8 January 2024

One full night will be charged for pre-bookings and late check-outs For Villas at Dinarobin Beachcomber, Paradis Beachcomber and Trou aux Biches Beachcomber, early check-in and late check-out are granted without any supplement

  • Check-in: 14h00
  • Valid 12 months as from the wedding date
  • Your wedding certificate will be requested at the time of check-in
  • Should you fail to produce your valid wedding certificate upon arrival, an extra cost will be charged directly at the hotel
  • Minimum Stay: 3 nights
  • Valid one year as from the wedding date
  • Your wedding certificate and your identity card will be requested at the time of check-in
  • The anniversary date should be within 6 months prior to the date of arrival or 6 months after the date of arrival
  • Offer applicable to every 5th wedding anniversary
  • The anniversary date should be within six months prior to the date of arrival or six months after the date of arrival

Once you have made your hotel reservation online, you will be asked to proceed with payment.

  • In order to secure online payments in EURO, the beachcomber hotels website uses the internationally recognized PAYBOX secure payment system, which incorporates the SSL (Secure Locket Layer) security protocol.

The PAYBOX payment interface also makes use of 3-D-Secure technology.  Designed by Visa and MasterCard, this system authenticates cardholders and prevents fraudulent use of their bank cards.  The 3-D-Secure system automatically redirects you to a bank interface where a code or personal piece of information provided separately by the bank must be entered after the card number, expiry date and cryptogram have been provided.  Once authenticated, the transaction is then either authorized or declined by the bank.

  • In order to secure online payments in USD, AUD, GBP and MUR, the Beachcomber Hotels website uses MIPS secure payment system, which incorporates the SSL (Secure Locket Layer) security protocol.

All confidential data (16-digit card number, expiry date and cryptogram) are transmitted directly in encrypted format to the payment gateway servers (of PayBox and MIPS) without ever passing through any physical device within the Beachcomber Hotels server system.

Once the bank details are validated, the secure payment management systems send an authorization request to the bank card network. 

The remote payment system then delivers an electronic certificate. In accordance with the provisions of articles 1316 et seq. of the French Civil Code, the electronic certificate shall serve as proof of the transaction date and amount and will be kept in the proper archives set up by Beachcomber Hotels.  Dates and times contained on the server shall serve as official records for the parties.

Kindly note that making an online payment implies that you are fully authorized to use the bank card provided for payment and that you have sufficient funds to cover the total cost of the transaction.

For all transactions, payment of the booking shall constitute signature and express acceptance of the sale with all that is included in the price.

Beachcomber Resorts & Hotels will not accept cash payments in excess of 500,000 rupees or an equivalent amount in foreign currency in order to comply with Section 5(1) of the Financial Intelligence and Anti-Money Laundering Act 2002, which provides that “any person who makes or accepts any payment in cash in excess of 500,000 rupees or an equivalent amount in foreign currency, or such other amount as may be prescribed, shall commit an offence.” Accordingly, pursuant to Section 8(1) of the Act, any person who commits such an offence “shall, on conviction, be liable to a fine not exceeding 10 million rupees and to penal servitude for a term not exceeding 20 years.”

Cancellations and amendments to confirm bookings are subject to the following fees:

  • No cancellation fee for stays cancelled up to 8 days prior to arrival
  • Cancellations as from 7 days prior to arrival: 100% of the total amount will be charged

Cancellations and no-show for Royal Palm Beachcomber Luxury:

For Junior Suites, Tropical Suites, Ocean Suites and Romance Suites only 

  • 7 days or less prior to arrival 100% cancellation fee on whole stay
  • No-Show 100% cancellation fee on whole stay
  • Unexpected departure 100% cancellation fee on the unused nights
  • Name changes will be accepted 7 days prior to arrival

Cancellation fees are applicable on room rates, meal supplements and offers as well as on any other package which has been prepaid (e.g. : wedding package)

For Palm Suites, Penthouse, Presidential Suites and Royal Suite only 

  • 21 days or less prior to arrival 100% cancellation fee on whole stay

PRIME SEASON: from 20th December 2023 to 8th January 2024 inclusive

  • The remaining balance should be settled by 15th November

Cancellation and no-show policy (20th December 2023 to 8th January 2024)

All hotels excluding Paradis Beachcomber and Dinarobin Beachcomber Villas

  • 45 to 31 days prior to arrival: 25% fee of the amount of the whole stay will be charged
  • 30 days or less to arrival: 100% fee of the amount of the whole stay will be charged
  • No show: 100% fee of the amount of the whole stay will be charged
  • Unexpected departure: 100% fee on the unused nights

Please note that cancellation charges for prime season are calculated on a nightly basis and are not governed by arrival date. Even if a stay begins prior to prime, the prime dates will incur cancellation charges once cancellation was within the timescale above.

Payment Conditions for Dinarobin & Paradis Villas (all year-round excluding 20th December 2023 to 8th January 2024):

  • Upon confirmation: 50% deposit will be required to confirm and secure the booking
  • 45 days prior arrival: 100% payment will be required

Paradis Beachcomber and Dinarobin Beachcomber Villas (20th December 2023 to 8th January 2024)

  • Prior 60 days: 15% fee of the amount of the whole stay will be charged
  • Between 59- and 49-days prior arrival: 60% of the amount of the whole stay will be charged
  • 44 days or less prior arrival: 100% of the amount of the whole stay will be charged

Cancellations & amendments to confirm bookings are subject to the following fees (all year-round excluding 20th December 2023 to 8th January 2024):

  • Cancellations 45 to 15 days prior to arrival: 50% of the total amount will be charged
  • Cancellations 14 days or less prior to arrival: 100% of the total amount will be charged
  • No show: no refund for nights booked

Please note that cancellation charges for prime season are calculated on a nightly basis and are not governed by arrival date.  Even if a stay begins prior to prime, the prime dates will incur cancellation charges once cancellation was within the timescale above.

In case of “no show” New Mauritius Hotels Ltd will charge the applicable cancellation fees (depending on the seasonality) as per the general Terms and Conditions.

Delays / extensions of stays:

Clients arriving on delayed flights but leaving on scheduled date of departure: New Mauritius Hotels Ltd will charge the full amount of the stay.

As compensation, the hotel will offer the following depending on the meal plan and hotel:

  • For clients who have booked Bed, Breakfast and dinner (MAP):   A complimentary lunch for each dinner not taken (due to the delayed flights)
  • For clients who have booked the optional All Inclusive at Victoria Beachcomber Resort & Spa, Mauricia Beachcomber Resort & Spa, Canonnier Beachcomber Golf Resort & Spa or for those who are staying at Shandrani Beachcomber Resort & Spa on all inclusive: A credit of Rupees (MUR) 1200 per adult & Rupees (MUR) 900 per child (12 – 17 years old) against extras (food & beverage) for every full day not utilized (due to delayed flights)
  • For clients who have chosen the optional All Inclusive at Trou aux Biches Golf Resort & Spa : a credit of MUR 1500 per adult and MUR 1100 per child (12-17 years old) against extras (food & beverage) for every full day not utilized (due to delayed flights)
  • For clients who have chosen the optional "Escape Package" at Dinarobin Beachcomber Golf Resort & Spa , Paradis Beachcomber Golf Resort & Spa: A credit of  Rupees (MUR) 1 200 per adult & Rupees (MUR) 900 per child, (12-17 years old), against extras (food & beverage) for every full day not utilized, (due to the delayed flights)
  • No compensation will be given to clients booked on Bed and Breakfast

Clients arriving on delayed flights but spending the number of nights originally booked at the hotel  (i.e. Leaving at a later date)

  • The hotel will charge for the whole stay with no compensation.

Clients arriving on scheduled date but extending their stay at the hotel due to non-operating flights

  • The hotel will charge 50% of the public rate for the extra nights (as per the meal plan chosen by the client).      
  • This is to be paid directly at hotel before departure.

All websites designed by and managed by Beachcomber Hotels may feature links to other sites operated by third parties. Beachcomber Hotels is not responsible for the privacy practices or the content of such web sites.

While every precaution has been taken, we cannot ensure that a third party will not unlawfully access private details and we advise you to take all necessary precautions and suggest that you do not permit others to access your personal codes or passwords.

  • No discount will be granted to guests staying at hotel during a cyclone.
  • No cancellation fee for stays cancelled up to 3 days prior to arrival.

Subject to our confirmation, and also to your provision of valid and correct credit card details for payment, your reservation will be irrevocably binding upon your clicking on “Confirm” on our website.

As we will send you a confirmation of your reservation by email, it is your duty to provide us with an accurate email address. Such confirmation will usually be made within 48 business hours after you submitted your reservation. If your reservation is not accepted, we will make every effort to provide you with a comparable alternative, which you are free to accept or decline. Our confirmation email will serve as proof of valid reservation and will contain relevant information about the reservation and particulars of the hotel concerned. If you do not receive such a confirmation, please notify us by e-mail at [email protected]  .

Payment Conditions for Dinarobin & Paradis Villas:

  • Upon confirmation: 15% deposit will be required to secure the booking
  • 45 days prior arrival: 100% payment will be required

  • 45 Days prior to arrival: 15% cancellation fees
  • Between 44 & 30 days prior arrival: 40% cancellation fees

  • Unexpected Departure: no refund for nights booked

PRIME SEASON: from 20th December 2019 to 8th January 2020 inclusive

  • The remaining balance should be settled by 15th November

Cancellations & amendments to confirm bookings are subject to the following fees:

  • Cancellations 45 to 15 days prior to arrival: 50% of the total amount will be charged
  • Cancellations 14 days or less prior to arrival: 100% of the total amount will be charged
  • No show: no refund for nights booked
  • Unexpected departures: no refund for nights booked
  • “Non Refundable” offer: no refund for nights booked

Please note that cancellation charges for prime season are calculated on a nightly basis and are not governed by arrival date.  Even if a stay begins prior to prime, the prime dates would incur cancellation charges once cancellation was within the timescale above.

For all stays during Prime Season (from 20th December 2019 to 08th January 2020 inclusive): 

  • Royal Palm – 10 nights

For all stays falling on nights 29th, 30th and 31st December 2019

  • 5 nights for the following categories: Junior Suites, Club Junior Suites, Club Junior Suites Beach, Club Senior Suites, 2-Bedroom Family Suites, 2-Bedroom Club Luxury Family Suites, Zen Suites, Zen Suites Beachfront, Senior Zen Suites
  • Villas – 12 nights (No check out between 26th and 31st December 2019 inclusive)
  • 7 nights for the following categories: Tropical Rooms, Ocean Rooms, Ocean Beachfront Rooms, Tropical Beachfront Rooms, 2-Bedroom Tropical Family Suites
  • 10 nights for the following categories: Senior Suites Beachfront, Ocean Beachfront Suites, 2-Bedroom Ocean Beachfront Family Suites, 2-Bedroom Luxury Family Suites Beachfront 
  • Villas and Presidential Villa – 12 nights (No check out between 26th and 31st December 2019 inclusive)
  • 5 nights for the following categories: Junior Suites, Tropical Junior Suites, Beachfront Suites with Pool, Beachfront Senior Suites with Pool, 2-Bedroom Family Suites
  • 7 nights for Pool Villas
  • 5 nights for the following categories: Superior rooms, Deluxe rooms, Deluxe Ground Floor, Senior Suites

Cancellations and amendments to confirm bookings are subject to the following fees for Villas at Dinarobin and Paradis Villas:

  • 60 days prior to arrival: 15% cancellation fees
  • Between 60 & 45 days prior arrival:  60% cancellation fees
  • 44 days or less prior arrival: 100% cancellation fees
  • Unexpected Departure: no refund for nights booked

Applicable Procedure in Case of Flights Delays/Cancellations due to Unforeseen Circumstances (Including Cyclones)

In case of “no show” New Mauritius Hotels Ltd will charge the applicable cancellation fees (depending on the seasonality) as per the general Terms and Conditions  

DELAYS / EXTENSIONS OF STAYS:

Clients arriving on delayed flights but leaving on scheduled date of departure: New Mauritius Hotels Ltd will charge the full amount of the stay.

As compensation, the hotel will offer the following depending on the meal plan and hotel:

  • For clients who have booked Bed, Breakfast and dinner (MAP):   A complimentary lunch for each dinner not taken (due to the delayed flights)
  • For clients who have booked the optional All Inclusive at Victoria Beachcomber Resort & Spa, Mauricia Beachcomber Resort & Spa, Canonnier Beachcomber Golf Resort & Spa or for those who are staying at Shandrani Beachcomber Resort & Spa on all inclusive:

A credit of Rupees (MUR) 1200 per adult & Rupees (MUR) 600 per child (06 – 17 yrs) against extras (food & beverage as well as Spa) for every full day not utilized (due to delayed flights)

  • For clients who have chosen the optional "Escape Package" at Dinarobin Beachcomber Golf Resort & Spa , Paradis Beachcomber Golf Resort & Spa and Trou aux Biches Golf Resort & Spa: 

A credit of  Rupees (MUR) 1 000 per adult & Rupees (MUR) 500 per child, (06-17 years), against extras (F&B) for every full day not utilized, (due to the delayed flights)

  • No compensation will be given to clients booked on Bed and Breakfast

Clients arriving on delayed flights but spending the number of nights originally booked at the hotel  (i.e.leaving at a later date)

  • The hotel will charge for the whole stay with no compensation.

Clients arriving on scheduled date but extending their stay at the hotel due to non-operating flights

  • The hotel will charge 50% of the Public rate for the extra nights (as per the meal plan chosen by the client).      
  • This is to be paid directly at hotel before departure.

Subject to our confirmation, and also to your provision of valid and correct credit card details for payment, your reservation will be irrevocably binding upon your clicking on “Confirm” on our website.

As we will send you a confirmation of your reservation by email, it is your duty to provide us with an accurate email address. Such confirmation will usually be made within 48 business hours after you submitted your reservation. If your reservation is not accepted, we will make every effort to provide you with a comparable alternative, which you are free to accept or decline. Our confirmation email will serve as proof of valid reservation and will contain relevant information about the reservation and particulars of the hotel concerned. The Following Terms and Conditions Apply to All Rentals:

   

Deposit Policy:

25% at booking

50% at 90 days (additional 25%)

Payment in full at 30 days

On-Line booking will automatically charge your card if not paid in full sooner.

Units 7 and 19 minimum rental 3 nights. For all other units, minimum 7 nights rental during Peak Season (Jan-Apr) and 3 nights the rest of the year.

Cancellation Policy - Refunds for cancellations will be given as follows:

Peak Season (Jan-Apr)

Full refund 90 days before check-in

Off Season (May-Dec)

Full refund 60 days before check-in

Prorated refunds are given only if unit is re-rented after the full refund period.

Refunds subject to a 10% service fee and applicable taxes.

Guest Reservation Contract Terms & Conditions

General Information - Our check in time is 4pm and check out is at 11am. Our office is on the left-hand side of Sunset Blvd., across from Pelican Brewery. We are open every day, 9am to 5pm.

Payment Terms – Once a reservation has been made, an email will be sent with a link to your Guest Reservation Contract. This electronic signature contract must be returned within 3 days to secure your reservation.

Deposits are not charged to your credit card on file until your signed Guest Reservation Contract has been received.

If your date of arrival is less than 30 days away, the entire reservation cost will be due in full. Reservations made less than 30 days before arrival may only be paid for with a credit card, money order, or a cashier’s check. We require a credit card to be kept on file with us even if you choose to pay by check.

If your date of arrival is more than 30 days away, a deposit of 40% will be due upon receipt of your signed Guest Reservation Contract. Your final payment is due no later than 30 days before your arrival.

Guest Requirements – You must be over the age of 25 in order to rent a home from Beachcomber Vacation Homes. This Guest Reservation Contract cannot be transferred to anyone else and subletting the home is prohibited. The guest signing this Guest Reservation Contract will be the responsible party for any intentional or malicious damage to the property for the length of the reservation (Please see our “Worry Free Damage Waiver” below). Our homes are in neighborhoods that have fulltime residents so please be courteous with parking, outside activities, lights, and noise.

Cancellation – If you need to cancel your reservation, please call our office right away.

STANDARD CANCELLATION PLAN

We have a no-refund cancellation policy unless the dates you reserved are re-rented to another guest. If that happens, then your money will be refunded to you in the same form it was received, less travel insurance if purchased. Because of this policy we highly recommend purchasing Rental Guardian Travel Insurance with your reservation.

Travel Insurance - We offer Rental Guardian Travel Insurance – specifically their Play Travel Protection policy and their Cancel For Any Reason policy (not available to residents of NH, NY, WA, and Puerto Rico). In the event you need to cancel your booked reservation and your dates are not re-booked, Rental Guardian may be able to refund your money depending on the circumstances surrounding your cancellation. Please see details at https://beachcombervaca.rentalguardian.com/ . Rental Guardian is an independent business and is not affiliated with Beachcomber Vacation Homes.

Number of Guests and Cars – Each home has a rental permit from either the city of Cannon Beach or Clatsop County that regulates how many guests may stay and how many cars are allowed to park. These limits are listed on our Website. If there are more people staying at the house than permitted, then such is a violation of this Guest Reservation Contract rental and constitutes grounds for immediate termination and eviction.

PETS – Dogs are the only pets allowed in our pet-friendly homes.

DOG-FRIENDLY HOMES

The Dog Fee is $60.00 plus tax per- dog, per- stay . Please make sure to clean up after your dog. Excessive pet mess may result in extra cleaning charges. Dogs are not to be left alone in a home unless in a crate . Any damage done by an unattended dog is not covered by the Worry-Free Damage Waiver. If a dog is found in a dog-friendly home without prior notice and consent as indicated by payment of the Dog Fee , then such is a violation of this Guest Reservation Contract and constitutes grounds for immediate termination and eviction. You will also be subject to a $750.00 fee.

NON-DOG-FRIENDLY HOMES

If a pet is found in a non-pet-friendly home without prior notice and consent, then such is a violation of this Guest Reservation Contract and constitutes grounds for immediate termination and eviction, in addition to a $750.00 fee.

ADA SERVICE ANIMAL

We applaud and welcome all ADA Service Animals. Animals whose function is to provide emotional support, comfort, or companionship do not qualify as service animals according to the ADA.

If you have an ADA Service Animal please let our office know right away so that we can make special arrangements in the event that you have chosen a non-pet friendly home.

Worry-Free Damage Waiver – Included with every reservation is a Worry-Free Damage Waiver. This is intended to cover any reported accidental damage to the home up to $5,000.00 by anyone in your party. In the event that something is damaged or broken you must call our office immediately in order for the Worry-Free Damage Waiver to apply . This Worry-Free Damage Waiver does not cover any intentional or malicious damage. The guest signing this Guest Reservation Contract is the responsible party for all intentional or malicious damage done by anyone in their party including structural damage, damage to furnishings, theft, unnecessary maintenance, and the need for extra cleaning beyond what is normally required at departure. The guest authorizes Beachcomber Vacation Homes to charge the credit card on file for this type of damage. If legal action is deemed necessary to recover damages, Beachcomber Vacation Homes will be entitled to recover administrative costs before, during and after any lawsuit and appeal.

Guest Responsibilities at Departure

1. Do not strip or make the beds or start any laundry.

2. Clean all dishes and start the dishwasher.

3. Take all garbage to the outside cans.

4. If furniture has been moved please return it to its original position.

5. Please do a final walk through of the house for left behind items – ( clothes in the laundry, phone chargers still plugged in, check the drawers and closets ).

6. Please leave the home reasonably tidy.

Smoking – There is no smoking of any kind – no tobacco, vaping, or marijuana - allowed in any of our homes. If you smoke outside please do so at a distance of at least 10 feet from the home and dispose of your smoking materials appropriately. If anyone smokes inside the home, or uses a vaporizer, then such is a violation of this Guest Reservation Contract and constitutes grounds for immediate termination and eviction. You will also be subject to a minimum $750.00 cleaning fee.

Weddings and Events -  NO EVENTS OR WEDDINGS ARE ALLOWED AT ANY OF OUR HOMES. If you have an unauthorized event, then such is a violation of the Guest Reservation Contract and constitutes grounds for immediate termination and eviction. You will also be subject to a minimum $1,000.00 cleaning fee. R V’s – There is no RV parking at any of our homes. If you need help finding parking for your RV please give us a call.

Trash – Please place all garbage and recycling materials in the cans provided. If you have excess garbage, please bag it, and let our office know when you depart so that we can pick it up. Your trash day will be noted in the house guest book.

Smoke detectors & CO detectors – Please check to see if you detectors are working and call us immediately if they are not so we can replace them. Batteries can die at any time, and we want you to have a safe stay with us.

Key Codes – Most Beachcomber Vacation Homes have a keyless entry system. You will receive your door code and keyless entry instructions 48 hours prior to your arrival. The code will not work until 4 pm on the day of your arrival and will deactivate shortly after 11 am on the day of your departure. If you need a little extra time for departure or if you are arriving earlier than 4 pm, please give our office a call and we’ll try to accommodate you if we can.

Keys are available at our office for those homes using keys, and you will receive this notification and directions via an email 48 hours prior to your arrival. Arrangements can be made for after-hours arrivals – we just ask that you please contact our office ahead of time.

Unforeseen Circumstances – Even the best-made plans can hit a snag and renting a vacation home is no different. If your home becomes unavailable due to plumbing, electrical or heating issues, roof damage or anything else beyond our control that makes it uninhabitable, we will try to move you to a comparable home. If a comparable home is not available, Beachcomber will give you the option of receiving a refund or choosing an upgraded home, subject to availability. If you choose an upgraded home, any increase in rental rate will be your responsibility.

Indemnify and Hold Harmless – Guest agrees to indemnify and hold harmless the owner and Beachcomber Vacation Homes and its officers, directors, agents, and employees of and from any and all claims, causes of action, damage, lawsuits, judgments, including attorneys ’fees, and costs, arising out of, relating to, or in connection with the reservation and/or use occupancy or rental of the home or property specified in this Guest Reservation Contract.

Legal – In the event of a breach of this Guest Reservation Contract or dispute concerning its interpretation or enforcement, the losing party shall pay the prevailing party’s costs, expenses, and attorney fees incurred. I give permission to the property manager to use a third-party to verify my identity and check criminal databases to confirm my reservation. Complete terms regarding the guest verification can be provided by the property manager. You may receive an email to complete your screening. Please check your spam inbox for this email and contact the property manager if you have any questions.

This popular beachcombing trip leaves from Orleans and travels to Chatham Harbor to the view the local seal colony. Enjoy their singing as they play in the water or lounge in the sun and be sure to bring your camera aboard this Cape Cod boat tour. After visiting with the seals, you are dropped off on Tern Island in the middle of Chatham Harbor, which is only accessible by boat. Relax on this uninhabited island, pack a picnic to enjoy, collect Cape Cod shells and delight in the peace and quiet. You’ll also stop by the Chatham fish pier to check if there are any fishing boats off loading their catch, an interesting process. This family-friendly tour is a great way to spend a few hours on your Cape Cod vacation and provides a great opportunity to take home one-of-a-kind souvenirs!

The boat and captain stay anchored near the beach while you explore. There are no facilities or lifeguards on the island. SWIMMING IS STRICTLY PROHIBITED .

  • We require that each party brings along a cell phone for communication with the captain.

  • Please respect the signage on the island that protects endangered birds and their nests.
  • You will need to step into ankle deep to mid-calf high water, just a few steps to the beach, beach shoes recommended.

  • We recommend that you bring along jackets/rain jackets and dress appropriately for the weather that may happen during your trip.
  • Children under the age of 12 are required to wear a life jacket that we will provide. However, you may bring along your own.

Private Cruise Cancellation Policy:

  • Customers will receive a full refund with 7 days notice of cancellation. Cancellations within the 7 day window – but more than 48 hours before departure time – will be refunded 50% of the cruise price but not the booking fee. No-shows and cancellations made 48 hours or less before departure time will not receive any refund.
  • Customers will also receive a full refund in case of operator cancellation, prior to departure, due to inclement weather or other unanticipated circumstances. Cancellations will be made just prior to the cruise departure time at the sole discretion of the captain. Shortened cruises based on a change of weather will be refunded on a prorated basis.

2. Bookings

  • All bookings are made with Beachcombers. When you book activities with us, you will be deemed to have agreed to these booking terms and conditions, and we will accept your booking on this basis. Your booking confirmation invoice will contain the services to be provided.
  • You are required to pay a non-refundable deposit of 50% of the service fees at the time that you make your booking, in order to secure your booking date. The remaining 50% of the service fees is due and payable seven (7) days before the booking date.
  • If your booking is made within seven (7) days or less before the booking date, you will be required to pay the full amount of service fees at the time you make the booking.
  • Each booking is subject to our acceptance in our sole discretion. If we accept your booking, we will issue you with a confirmation invoice.
  • Your full name;
  • Payment details; and

3. Cancellation

  • We reserve the right to cancel or alter the activities at any time before its scheduled availability if it’s not viable for us to operate the service as planned. This could be because of weather, natural disasters, or other external events over which we have no control.
  • If we cancel your activity, you can either transfer the amounts you have paid to another activity or receive a full refund (subject to availability of dates and additional charges for the difference between your original booking and the rescheduled booking).
  • Please note, if we cancel your booked service, we are not liable for any incidental or consequential expenses or losses you may have incurred because of your booking, including, but not limited to, visa, or travel insurance excess. Nor are we liable for any incidental or consequential expenses or loss you may incur because of the cancelation or alteration of the activity/ies, including but not limited to, travel charges or fees for changed travel arrangements.
  • If you cancel more than seven (7) before the booking date, we will refund the service fees less any administrative fees.
  • forfeit your payment; or
  • reschedule the booking for another date within 12 months of the booking date (subject to availability of dates and additional charges for the difference between your original booking and the rescheduled booking and subject to additional administrative fees).
  • You acknowledge and agree that these cancellation terms are reasonable in recognition of the preparations we make for each booking and our having reserved that booking date for you.
  • We strongly advise you to take out cancellation insurance at the time you make your booking, so it will cover any cancellation fees.
  • Please note, if you fail to join your booked activity, join it after departure, or leave before your activity is complete, you will be considered to have cancelled your booking and we will not make any refund.

4. Inclusions and Exclusions

  • The payment of the invoice for your activity/ies includes the inclusions as advertised by us from time to time for that service, subject to change in our sole discretion without notice to you.
  • All inclusions are subject to availability.
  • Meals other than those specified in the inclusions information as advertised from time to time and subject to availability;
  • Beverages, including alcoholic beverages, other than those specified in the inclusions information as advertised from time to time and subject to availability;
  • Travel insurance; and
  • Fees or costs incurred in the case of illness.
  • We reserve the right to place restrictions upon participation in certain activities and bookings from time to time in our sole discretion, including but not limited to age restrictions.

5. Payments

  • Cost of goods damaged / requiring replacement – e.g breakage charges, etc.
  • Payments may be made electronically through the means available on through our website from time to time.
  • Where you make a payment, you warrant that you have the necessary authorisation to make that payment from that payment source.
  • Where you fail to make a payment when it is due or if a payment has been declined, we reserve the right to cancel or reschedule your booking in our sole discretion.
  • your deposit becomes due and payable upon making a booking;
  • the remainder of your booking costs become due and payable seven (7) days prior to your booking date;
  • seven (7) days after we issue you with an invoice for additional fees and charges as set out in these terms and that invoice has not been disputed.

6. Limitation of Liability and Indemnity

  • In the absence of our negligence, we are not liable for any cancellations, diversions, substitution of equipment, variations, postponements or any other act, omission or default (whether negligent or otherwise) of any supplier nor are we liable for any loss or damage to baggage or property, injury, illness or death, or any other loss (including consequential loss) damage or claim whatsoever arising from the act, error, omission, default or negligence of any person not our direct employee or under our exclusive control.
  • We are not responsible for any criminal conduct of any third party.
  • Subject to clause 6.1, where a safety device (including but not limited to life jackets and helmets) is made available to you, neither we nor any supplier concerned will be liable for death, injury, or any loss or damage whatsoever you suffer from any accident or incident if you do not use the safety device at the time of such accident or incident.
  • We are not liable for any injury, damage, loss, delay, additional expenses or inconvenience caused by your acts, omissions or defaults, your state of health, medical condition or circumstances or other reasons which are beyond our control, including force majeure events or failure of equipment or machinery.
  • Any information on our website or offered by our staff and crew is general in nature and should not be considered a replacement for individual professional advice which considers your personal circumstances and situation.
  • We make no warranty or representation that the goods and services which we offer are fit for any particular purpose.
  • You agree to hold us and our related entities harmless and indemnify us against all claims, demands, loss or damage, including by third parties which is caused by your breach of these terms and conditions, your improper use of our Website, goods and services, or breaching any representation which you make to us.
  • You must inform us prior to participation in any activity, if there is a reason, including medical reason, which may interfere with, prevent or hinder your ability to participate in that activity, you have, prior to engaging in the activity, sought the relevant and necessary professional advice and been informed by that professional that they are able to participate.
  • You are responsible for taking all reasonable actions and precautions to protect their own safety, the safety of other participants, crew and staff and safety of your own and others’ property. Beachcombers shall not be liable for any loss or damage (including personal injury) which results from your failure to take such reasonable actions and precautions.
  • You acknowledge and agree that you are aware that there are risks which are obvious and inherent to the activities, including boating, water-based and beach activities. Beachcombers shall not be liable for any loss or damage (including personal injury) which results from the materialisation of an obvious or inherent risk of the activities.
  • Beachcombers crew are not trained medical professionals, and should medical attention be required for a participant, it is an inherent risk of boating, water based and beach activities that it may take some time for this medical attention to arrive.
  • You must, at all times, follow the reasonable direction of our staff and crew. We shall not be liable for any loss or damage (including personal injury) which results from failure to follow our (including our staff and crew’s) reasonable direction.
  • You must only consume alcohol in line with direction by us and in accordance with relevant legislation. If you consume alcohol you agree to do so responsibly. We reserve the right to suspend all activities, including for all participants in their sole discretion and refuse to serve, or remove from the participant, any alcohol.
  • Participation in the activities is not permitted while under the influence of or in possession of any illicit substances.
  • You may not possess, or use at any time during the activities, any thing, item, substances or otherwise which may cause harm or offense (in Beachcombers’ sole discretion) to us or to other participants, staff and crew. Beachcombers reserves the right to remove an item from a participant’s possession without being obliged to return that item at any time.

7. Miscellaneous

  • All content contained on our Website and related marketing material is owned or licensed by Beachcombers. In using our Website, you agree that you will not copy, reproduce, distribute, publish, or use in any manner any content on our Website and related marketing material without our written consent or other than as permitted under the Website Terms and Conditions.
  • Participants may be photographed, recorded or videoed by Beachcombers and they give their permission for Beachcombers to use these photographs, recordings or videos in their sole discretion including for social media, advertising or business promotion purposes.
  • To the extent that you share your intellectual property with us in anyway, including but not limited to sending it to us, tagging us in content, commenting on our social media, or interacting with us online, you grant us an irrevocable world-wide license to use that intellectual property in our sole discretion including for social media, advertising or business promotion purposes.
  • In the event that any term or condition contained in these terms and conditions is unenforceable or void by operation of law or as being against public policy or for any other reason, such term or condition shall be deemed to be severed from this contract or amended accordingly only to such extent necessary to allow all remaining terms and conditions to survive and continue as binding.
  • We endeavour to ensure that all arrangements we have made for your booked service are implemented as arranged. If a problem occurs, please try to resolve it with our staff and crew at the time, so they can attempt to rectify the matter. If satisfaction is not reached, put any further complaint to us in writing within 30 days after the booking date.
  • Any personal information that we collect about you may be used for any purpose associated with the operation of a tour or to send you marketing material in relation to our events and special offers. The information may be disclosed to our agents, service providers or other suppliers to enable us to operate the tour. Otherwise, we treat your details in accordance with our privacy policy which is accessed via privacy policy
  • We are not responsible for third party links, services or site which may be referred to or linked on our Website. These third-party offerings are accessed at your own risk, without our endorsement, approval or control.
  • All prices on this website are listed in Australian Dollars and are GST inclusive unless otherwise stated. We reserve the right to changes the prices for services from time to time in our sole discretion.

Beachcomber marketing (pty) ltd trading as beachcomber tours (herein called the company), 1. package price.

Package prices quoted are based on prevailing air fares, fuel surcharges, airport taxes, hotel prices, land costs and rates of exchange. The Company reserves the right to adjust package prices in accordance with increases as well as any seasonal adjustments and currency fluctuations.

Once hotel reservations have been confirmed, the Company reserves the right to substitute hotels with others of a similar or higher category at no additional cost to the client, even after departure from South Africa. Hotels reserve the right to close restaurants and facilities due to operational reasons and seasonality, without prior notice. All facilities and amenities are subject to change at any hotel without prior notice. Certain sports and facilities mentioned may have age restrictions and additional charges may apply.

3. Hotel, land supplementary and airline special requests

The Company will endeavour to comply with special requests; however, the Company cannot guarantee that these requests will be met. No request can be implemented unless stated in writing to the Company.

4. Not included in package prices

Group and FIT (free independent traveller) inclusions differ. Package prices quoted do not include airport taxes and fuel surcharges and these costs are listed separately. Any additional surcharges levied by the airlines, costs of obtaining visas, re-entry permits, vaccinations, passports or any other travel related documentation, telephone calls, laundry, entertainment arrangements not shown in the brochure, meals, beverages and excursions (unless specified), or any other item of a personal nature, are not included in the package. Package inclusions are strictly as per the final confirmation and it is the clients' duty to familiarise themselves with such confirmation before departure.

5. Reservations

On confirmation of the booking, please complete the e-booking form which is the acceptance of the Company’s terms and conditions. A non-refundable deposit of between 20% and 40% of the total package price is payable within 72 hours of confirmation of the reservation. In addition, the total cost of air tickets, airport taxes and fuel levies, must be paid by the due date stipulated by the airline. The balance owing on the invoice must be paid eight weeks prior to departure or, alternatively, as per the date stated on the confirmation. The Company reserves the right to cancel any reservation for which the total package price has not been paid by due date, in which event the deposit will be forfeited to the Company. The Company guarantees the price of land arrangements once full payment is received, except where subsequent increases are beyond the control of the Company. Airfares, airport taxes and fuel surcharges are subject to the prices, ticket time limits and conditions quoted by the airlines and cannot be guaranteed by the Company. The Company is an intermediary and acts on behalf of its principals and cannot be held liable for any increases, cancellations or changes effected by these principals. These principals have their own terms and conditions which will apply to the client and such conditions will prevail.

6. Method of payment

The Company will accept payment for all arrangements in cash; electronic funds transfer (EFT) or credit card. For payment by credit card the Company offers an online credit card payment facility to Visa, MasterCard, American Express and Diners credit card holders via a 3D secured site. Certain international cards are not compatible with this site.

7. Cancellations and curtailment

Land arrangements.

In the event of the client cancelling a reservation for any reason, such cancellation must be made in writing and in such instances cancellation charges plus 15% VAT will be levied in accordance with the maximum charges that can be imposed. From time of booking up to eight weeks prior to departure, the deposit is forfeited. Cancellation fees for Villa bookings and travel during peak periods, being Christmas, New Year and Easter but not limited to these periods only, will be more stringent. Cancellation fees as per below:

  • 8 Weeks prior: 25% of total package price
  • 6 Weeks prior: 40% of total package price
  • 4 Weeks prior: 50% of total package price
  • 3 Weeks prior: 80% of total package price
  • 2 Weeks prior: 100% of total package price

Air arrangements

Cancellation fees apply to air tickets, and selected airport taxes and fuel surcharges once air tickets are issued. The cancellation fees vary from 25% to 100% dependent on the air ticket issued, plus 15% VAT. Many airline offers are accompanied by strict terms and conditions. Airlines are non-negotiable post ticket issuance.

8. Amendment and administration fees

Amendments to confirmed land reservations will be processed at a fee of R200 (including VAT) per person for each alteration made to the booking after the initial reservation is made. If notice of amendments is received within eight weeks of departure, cancellation fees as per point 7 may be levied. Administration charges will be levied on all documentation/vouchers submitted for reissue or refund. Changes to air tickets, once they have been issued, constitute an amendment fee if the airline permits such a condition together with an administration fee. Guaranteed departures and most discounted airfares may not be amended once payment is received.

9. Refunds and unused services

No refunds will be made for no-shows (clients who have booked and paid for services for a specific date and do not show or amend within 24 hours of departure date), or any unused services irrespective of whether they form part of the basic inclusive package price, or whether they are in respect of pre-booked optional arrangements.

The Company does not hold itself responsible for any delays prior to departure nor during travel to any hotel/resort mentioned in this brochure whether brought about by technical difficulties, strikes, political unrest, weather conditions, force majeure, airline schedule or time changes, rescheduling or any other circumstances whatsoever, whether foreseen or unforeseen. The Company will, however, endeavour but will not be obliged to assist clients during these periods and it is understood that any expenses relating to these unscheduled extensions (e.g. hotels, meals, beverages, airfares, telephone calls, etc.) will be for the client's account.

11. Travel documents

Documentation is only prepared on receipt of a booking form and full and final payment has been cleared through the Company's bank account. As per IATA (International Air Transport Association) ruling, airlines require the name on an air ticket to be exactly as per the passport name. Travel documents will be issued as per the booking form's first name and surname. All clients will be personally and solely responsible for ensuring that they are in possession of the correct documentation prior to their departure.

12. Itinerary alterations

The Company reserves the right to cancel the client's travel arrangements prior to departure, in which event the entire package price paid by the client will be refunded without prejudice and any further obligation on the part of the Company. While every effort is made to keep to all itineraries, the Company reserves the right to make any changes for the client's convenience. The duration of the travel package may have to be extended or curtailed owing to unforeseen changes in transport schedules. Any resultant expense will be borne by the client, and any saving refunded.

13. Special offers

Special offers booked by Beachcomber Tours South Africa are offered to the South African and African markets only and offers may not be combinable with any other markets.

14. Passports, visas, vaccinations, inoculations, re-entry permits and unabridged birth certificates

The responsibility to obtain correct, current and valid passports and passport requirements, visas, vaccinations and re-entry permits where required, is that of the client alone. Clients travelling with children under 18 years old must be familiar with the SA Immigration Regulations that came into effect on 01 June 2015. The Company will not be held responsible or liable for any consequence of any nature arising from the client failing to ensure that he/she has complied with all such requirements.

15. Insurance

Travel insurance is essential. We strongly advise clients to at least take out travel insurance against cancellation, curtailment, illness, loss of baggage, personal accident, personal liability and default at the time of booking among other possibilities. Insurance policies must always cover full vacation periods.

16. Liabilities

The Company makes every effort to ensure that all arrangements and services connected with your travel arrangements will be carried out as specified in the most efficient and effective way possible. However, being intermediaries, we do not have direct control over the provision of services by suppliers and, whilst they are in all cases selected with the utmost care, we do not accept liability for error and omissions of such suppliers. It is the client's responsibility to satisfy themselves with any local laws, terms and conditions and applicable insurance options, if any, for any facilities used or hired.

17. Responsibility

The Company acts as an agent only in producing and booking the various travel arrangements featured in this brochure, and on condition that it shall not be liable for any loss, damage, injury, accident, delay or any other irregularity that may be occasioned by the hotel and any defect in any vehicle, or other form of conveyance, or by error or default of any company or person engaged in conveying clients, carrying out the arrangements of travel, or otherwise in connection therewith.

18. Airline responsibility

The airline concerned is not to be held responsible for any act, omission or event during the time the clients are not aboard its aircraft. The client ticket in use by the airline, when issued, shall constitute the sole contract between the airline and the client. E-tickets (electronic air tickets) do not carry the terms and conditions but should a client require these, the contracts may be found on the website of each airline.

19. Airline information: luggage/seating/special requests/sequence of air tickets

Please refer to the relevant airline for baggage allowance and restrictions. Clients are reminded that they are responsible for reconfirmation of flights more than 72 hours prior to departure and to ensure that the airline has had no schedule or time changes. Failure to do so may result in the cancellation of a flight reservation by the airline. Airlines will do all possible to satisfy seat requests. Seating is not guaranteed due to operational and safety requirements. A fee is charged for selected seats and booking classes, please familiarise yourself with the airline terms and conditions on the airline website prior to the purchase of airline seats. Any medical and wheelchair requests must be confirmed by the airline prior to the airline ticket being issued. Air ticket itineraries consisting of more than one flight sector may not be used out of sequence or to 'skip' one flight sector, as this will void the entire balance of the journey/itinerary.

20. Airline overbookings

The Company is not responsible for overbooking by airlines resulting in clients being denied boarding. It is the airline's responsibility to re-route clients on alternative routes at the airline's expense, provided clients check in on time.

21. Transportation by road

Clients need to advise the Company in writing should upgraded transfers be required due to additional baggage or sporting equipment being transported. Upgraded transfers will be at an additional cost to the client. Standard transfers cannot accommodate infant/baby or booster seats. If these seats are required, the request must be made in writing to the Company and private transfers will be booked at additional costs to the client. The Company must be advised if clients are arriving with car seats.

22. Luggage

Each provider permits different baggage and sporting allowances. It is the client's responsibility to ensure that their baggage and sporting allowance falls into the provider's acceptance policy. The Company will not be responsible for any additional costs incurred if these requirements are not met.

23. Car hire

If clients intend to drive a rental car, a valid South African driver's licence is accepted; alternatively, an international driver's licence is required. Drivers must be 21 years old in order to hire a car. The car hire terms and conditions shall constitute the sole contract between the car hire company and the client.

24. General information

The Company cannot be held responsible for any charges that appear on a client's credit card, nor accept responsibility for having any of these charges reversed or corrected upon the client's return to South Africa.

25. Travel declarations

The Company requires that all foreign payments that are made on behalf of the client must be deducted from the client's foreign exchange allowance. A currency declaration to this effect must be lodged before final documentation can be released.

27. Law of governance

These Terms and Conditions shall be governed by the laws of the Republic of South Africa.

The Website www.beachcomberonline.co.za sells Mauritius and Seychells holiday packages online. The use of any product or service bought from this Website is at the purchaser’s risk. The purchaser/ user indemnifies and holds the Provider harmless against any loss, injury or damages which may be sustained as a result of using the products sold on the Website.

The private information required for executing the package/s placed through the e-commerce facility, namely the User’s personal information and credit card details, delivery address and telephone numbers will be kept in the strictest confidence by the Provider and not sold or made known to third parties. Credit card details are not kept by the Provider under any circumstances.
