Traveling Piano Man

The traveling Piano Man, Harry Perry III, has been playing piano in the greater Cincinnati are for nearly 60 years. He started playing in bars as a teen—what can one say, the laws were a little more lax then—and has been entertaining at private parties, coffee houses, weddings, slightly more reputable bars, parades and celebrations from Loveland to Cheviot and all places in between.

Harry tailors the play list to his audience and the event, from classical to ragtime, jazz, pop and rock. He can also provide a selection of prerecorded songs to play between live performances. And while the music is great, he also has been known to play a creative game of Name That Tune and other interactive musical games that draw in a crowd.

Harry has a special fondness for playing in assisted living and retirement communities around greater Cincinnati, including several in Loveland, Madeira, Deer Park and more. “There is nothing better than seeing people who may not be communicative any longer, smiling and tapping a foot, cane or walker to the beat.”

It is his firm belief that music is a language of joy that can break through most barriers and he loves sharing music with all who wish to listen.

How to Practice Piano While Traveling – Keeping Up Your Chops

As far as traveling musicians go, pianists are usually stuck with the short end of the stick. After all, it’s no easy feat to fit a Steinway and Sons Grand Piano into your RV as you set out on a cross-county road trip, nor is it a cinch to cram your prized Bosendorfer into the overhead bin of your trans-Atlantic flight to Europe. 

How then do you practice piano while traveling? The most important thing is to keep an open mind as what follows are a few different, if not unorthodox, methods to keep up your musical chops while you’re traveling.

We’ll explore the following:

  • “Travel-sized” Keyboards
  • Playing Piano Without a Piano
  • Sight Reading
  • Active Listening
  • Chilling Out/Doing Nothing

That smart phone in your pocket? The tablet the TSA so frequently reminds you to take out of your bag and place on the conveyor belt time and time again? These devices are actually very useful in practicing piano while traveling. Whether you’re just learning to play, or you’re a seasoned pro, there are dozens of apps out there for you. 

Simply Piano – Easy to use app filled with basic workouts to keep your piano playing skills on the up and up as you travel. Also utilizes your phone or tablet’s microphone to “listen” to your playing and suggest ways to improve. Available for both iOS and Android.

Small Pianos/Keyboards

If tiny screens aren’t your thing, you might consider small, portable pianos you can take with you on your travels. While it might not be advisable, or practical, to cart around a hefty 88-key keyboard, there are plenty of options in the 61 to 73-key range that will allow you to flex your piano chops no matter where in the world you wind up!

Many of these mini-pianos also run on batteries, which can be a tremendous help when you’re traveling internationally and your “all-in-one” travel adapter is already chock-full charging your phones and tablets and things. Here are a couple portable piano options to consider:

These are just a couple of good keyboards to consider as you look for your perfect traveling piano.

No Piano Required!  

Some of us prefer to travel without the trappings of technology. We cast aside devices that keep us tethered to our regular day-to-day and instead, look to disconnect as we travel. If you happen to be anti-phone and anti-portable keyboard, you’ve still got to keep those fingers limber! 

One easy way to keep up finger dexterity is to practice “playing” on a table. Recommended among piano teachers, “playing” piano (without really playing piano), on a flat surface actually helps ingrain muscle memory, improves posture, and strengthens your fingers. 

It’s a cheap (free is always good) and convenient (flat surfaces are usually abundant world-wide) way to practice piano while traveling. Check out these cool clips to see how it’s done!

You might also consider bringing a piece of sheet music with you on your travels. Practicing sight reading improves how you move through a piece of music and makes it easier to translate what you see with your eyes vs. what your fingers wind up playing. 

In fact, you can use this sheet music as you “play” on flat surfaces. Pick your favorite composition, pick a public place, and watch in amazement as crowds gather to watch the “pianist-without-a-piano.” Side note: This is an easy way to meet people as you travel abroad!

Even when you are at home and don't have a piano for whatever reason, there are still plenty of ways to learn in your free time.

how to practice piano while traveling

You play with your fingers, but you hear with your ears, and one of the best ways to practice piano while you are traveling is to do a lot of listening. Listen to some of the local composers and their compositions. Listen to local music and its instrumentation.

But don’t just listen passively.

Practice “active” listening. Before you leave for your trip, ask your piano teacher for some tips to integrate active listening into your practice. For instance, while you listen, write down the melodies of the piano or practice writing out the music as you listen. Identify harmony, or harmonies. 

Transcribe, as best you can, the music you hear. Pretend you have to teach this music to another student. There is no better way to demonstrate mastery of a subject than to be able to teach it to another.

These active listening ideas are a very imaginative way of practicing piano while you travel. 

Write  

Did you see the sun succumb to the sea in Santorini? Did you fall in love with the girl with the luminous smile and deep brown eyes in Paris? Write a song about it! Pick three chords and write a melody (all the best songs are usually the simplest) and hum it into your phone, write it down on sheet music, or scribble it down on the back of the menu from the restaurant you had the “best meal of your life” at. 

Writing music is an excellent way to practice not only your piano skills, but also a way to encapsulate some of the things that take your breath away as you travel. As they say, when words fail, music is there (or something like that). 

Relax/Time Out

Lastly, sometimes the very best way to practice piano while traveling is to not practice at all. Go out, take in your surroundings, enjoy the people, places, and things you see along the way. Experience new cultural practices, try new foods, take lots of pictures to show your friends back home. Take that hike with the amazing view or take the time to do nothing at all. 

Travel opens us up and broadens our horizons. Let the “travel muse” find you and be accepting of the possibility of the wonderful music you’re going to want to write and play upon your return home.

Traveling Keys Music Studio was founded in Utah County by Natalie Perdue - a classically trained pianist of 19 years. She noticed parents and students preferred the convenience of in-home piano lessons along with a teacher who would be the perfect fit. Natalie took both those ideals and created Traveling Keys Music Studio.

Guiding Principles

1st - We help students have fun with lessons while learning the fundamentals of music!

2nd - Students are taught piano lessons in their own home -- a place of comfort and convenience - by a qualified and compatible teacher.

3rd - Recitals are held three times per year, giving students multiple opportunities to develop their performing skills and show off their hard work!

What inspired you to develop traveling pianos.

During the 2020 COVID-19 lockdown in Los Angeles, it was almost impossible to get recording artists to the studio to record our then-planned new libraries.  So the only options to create something new would be creating something from recordings that I, alone, could do.  And those options were either a new solo strings library (which I was NOT in the mood to do after the release of Lyric Series Strings Quintet), or to record my beautiful Yamaha G5 grand piano.  And my good friend John Walz (principal cellist - LA Opera) told me that the room where the piano sits has a wonderful sound with great acoustics!

 I knew that there were already so many great piano libraries out there, and also knew that it could be difficult to compete.  But, it was my only viable choice at the time.  So after a few "dry runs" at it, I sent a trial, "bare bones" version to a few professionals I know.  To my surprise, all responded quite favorably, and added that I should do it "for real".

I see that Traveling Pianos features an additional Yamaha C7 as its default, not the G5.

After doing that "dry run" version, I wondered if I should try to do a bigger, more "industry-popular" piano.  Then I remembered my friend Michael Lehmann-Boddicker had a C7 at his studio.  I contacted him about checking it out.  (After all, not all C7 pianos sound the same - I've heard some real "duds" out there!)  It only took a minute of playing that thing to realize just how special it was!  It really had that thunderous low end without losing any "sparkle" throughout the entire range.  And as an added bonus, Michael happened to have had a Disklavier setup there.  That would make recording different velocities much easier.  

Why is it called Traveling Pianos?

The quality of that C7 piano evokes the feeling of "traveling" though time; successfully covering many different musical styles.  And since so many different artists have put "hands to keys" on it, it's like it has "traveled" to and from these special performers.  And now, as the "Traveling Pianos" sample library, it can quite literally "travel" to YOU.

How does Traveling Pianos stand out?

Firstly, it just SOUNDS amazing out of the box.  Having compared it to almost every other popular piano library out there, it definitely has a sound like no other.  This is true of both the C7 and the G5.  One of my beta testers said that he could play classical, jazz and pop without changing a thing.

Secondly, the sample footprint is wonderfully low without losing the full range of dynamics whatsoever.  Both pianos load TOGETHER in SECONDS.

Thirdly, we have created over 20 creative built-in presets.  And you can customize and change any of these presets via EQ, 3 Mic positions, reverb amount, room size, added tines, string and saloon (honky tonk) layers. 

And Fourthly, we have created multis that stack both pianos on top of each other.  Both pianos are tuned so precisely that layering them together became feasible.  And with the addition of string, saloon, and tine layers, the creative possibilities are endless.

How was TP recorded?

YAMAHA C7: CLOSE MICS:

  • 1975 AKG 414s w C12 capsules refurbed by Bob Katz direct wire (no patch bays) to original Neve1073’s mounted by Brent Averill.
  • Bass strings @9” above where strings cross in center of harp.
  • Treble strings @9” above where the harp separates extreme high strings from mid high strings.
  • 1987 Neumann U-87’s (never used before 2018 - new old stock) modified by Stephen Paul in 1987 and further modified by Toby Foster in 2018.

"I used to use Matt Hyde type mic-ing in cardiod right over the hammers at 6” up facing toward pins for that very bright David Foster Pop punch through a track in pretty extreme stereo. Now I much prefer a combo of the fullness of the mid/low string crossing balanced with upper harmonics & resonance  over the high strings including or maybe especially the undamped extreme high strings. There’s a rich life and natural warmth to those harmonics.

The edge mic-ing technique I got from James Horner and  his engineers Simon Rhodes and orchestrator Simon Franglen who  essentially put the mics where vocal soloist would stand in the ‘crook’ of the piano. The room sounds big with a natural decay because of the perfect dimensions by Carl Yanchar and walnut floor with acoustic damping & diffusion only on the 6’ and under plane.

The ‘omni only’ approach came from my dear friend Aspen Pittman (Founder Groove Tubes and Aspen & Associates) whose opinion was that ALL mics behave better in omni - patterns are brought about by introducing electronics/phase manipulation.  I listened and agreed and have never gone back except when trying to isolate say an acoustic guitar from a voice or overhead drums from a kick pedal.

I just put my head inside the piano and listen for the sweet spot, stand at the edge and listen for the sweet spot and then listen to where the room wants to give back the best ambience. Simple really." -Michael Lehmann Boddicker

What was your inspiration behind all the sound design style presets?

I wanted to offer something more than just the great-sounding pianos as they were out-of-the-box.  So I started by adding a cool "string" or "saloon" layer option.  I also customized the pianos themselves by focussing on different styles and placing them in different rooms.  It's almost as if you're "traveling" to these different spaces and styles.

A centenarian who starts her day with gentle exercise and loves walks shares 5 longevity tips, including staying single

In 1924, the Winter Olympics were held for the first time, the Ottoman Empire fell, and the Soviet Union was officially recognized as a state. It was also the year that Joyce Preston, who turned 100 years old last month, was born in the British town of Stockport.

Preston has spent her 10 decades well. As well as working for a cotton research company, she played the piano and sang in choirs for 90 years before winding down in recent years, and has traveled the world with friends, falling in love with the Middle East in particular.

A few months ago, Preston moved into Care UK's Abney Court care home. There, she starts her day by doing yoga or gentle exercise and loves going for walks.

If current trends continue, centenarians like Preston won't be such a rarity: it is estimated there will be eight times as many worldwide by 2050. And considering that by 2023, the US Bureau of Labor Statistics estimates 9.9% of people over 75 will still be working, up from 8.2% in 2022, it's easy to see why longevity is such a buzzy topic.

For those of us who don't have the funds or inclination to spend millions on longevity a year like tech exec Bryan Johnson , whose motto is "don't die," it's heartening that most experts agree that eating healthily and exercising regularly can have a hugely positive effect on our healthspans.

Preston shares her secrets for living to 100 and staying active into older age.

Stay single

Preston never married, and her biggest tip for reaching 100 is to "stay single."

The research on relationship status and longevity is mixed. Studies show that married people tend to live longer, possibly because they are less likely to be lonely and stressed.

But Paul Dolan, professor of behavioral science at the London School of Economics, told The Guardian that women who never marry or have children are the healthiest and happiest because they don't have to "put up with" a partner.

But marriage can lead to better financial stability and emotional support, he said, suggesting that the least stressful option is best.

Have lots of friends

Although Preston doesn't have a spouse, she has plenty of friends and spends a considerable amount of time with them.

She advises young people wanting to reach triple figures to "have lots of friends to keep you busy and for companionship."

According to gerontology professor Rose Anne Kenny, based at Trinity College Dublin, social interaction is as beneficial for longevity as eating a good diet or exercising.

She said this could be because loneliness has been linked to chronic inflammation , which researchers believe increases the risk of diseases such as cancer, heart disease, and strokes.

Don't act your age

Research suggests that thinking positively about aging could help people live longer — possibly as much as 7.5 years according to one 2002 study that compared different perceptions toward aging.

Preston said she doesn't let her age hold her back and maintained her independence by continuing to drive until recently.

Be religious

As a founding member of an independent evangelical church, religion is important to Preston, and she believes it has contributed to her long life.

Researchers from LongeviQuest , an organization that validates the ages of supercentenarians, previously told BI that most of the 110+ year-olds they spoke to in Latin America were very religious, and it appeared to help them stay positive.

Religion itself might not be the secret sauce for longevity. Research suggests spiritual people may live longer because of the potential mental health benefits, with one 2023 study linking it to resilience and life satisfaction in older people.

Dr. Joseph Maroon , a neuroscientist and eight-time Ironman triathlete who still competes at age 84, previously told BI that spirituality is one of the four pillars of health for him.

Keep learning

As a member of the University of the Third Age, a charity providing opportunities for retirees to learn new skills, Preston has kept learning into her 10th decade.

Learning new things is thought to help prevent cognitive decline in older age, Heidi Tissenbaum, a molecular, cell, and cancer biology professor who researches healthy aging, previously told BI.

How Fisher-Price’s ‘Purple Monkey’ Mat Became a Viral Hit Among Millennial Parents

“The Fisher-Price Kick and Play ‘purple monkey’ mat was sent as an unsolicited gift from a relative,” Dan, a fellow parent at my company tells me over Slack. “It appeared on my doorstep without any indication of its intentions to permanently overwrite sections of my memory. Sort of like when those kids first find Jumanji and don’t realize the game has its own motives.”

Sounds like the beginning of a horror movie , but IYKYK. You’re likely here reading this because you saw the photo and immediately felt a sense of nostalgia, joy, or dread—or some mix of all three—as a soft ratatat and the lyrics, “Maybe you could be a purple monkey in a bubblegum tree….” filled your head. If you found yourself here for other reasons, allow me to introduce you:

Officially known as the Fisher-Price Kick & Play Piano Gym , the baby activity mat has gone viral among parents of newborns for being as ubiquitous as it is beloved with the “tummy time” set. The machine-washable mat comes with several toys, from a self-discovery mirror to a round crinkle pad, and a removable piano with a pre-recorded playlist of catchy tunes that includes the absolute banger, “Maybe” (a.k.a. the purple monkey song).

The earworm has garnered over 1.2 million plays on Spotify, a cover by John Legend , and hundreds upon hundreds of feverish Reddit posts and TikTok videos all praising the mat’s popularity with babies and parents’ inability to get “Maybe” out of their heads.

A spokesperson from Fisher-Price wouldn’t provide exact numbers on the mat’s success, but did share that it’s considered the number one gym in the world according to market research company Circana. And indeed, I’ve never had an easier time soliciting quotes for an article. I was flooded with responses from parents eager to share how much they love, hate, or love to hate this mat:

“The songs were mine and my husband’s Spotify Top 5. All five.”

“Haunts my dreams.”

“About two years ago, I was at a friend’s house and the purple monkey song came on. I got a sick feeling in my stomach because it reminded me of the exhaustion and stress of having a new baby.”

“A very active group chat in my life: the monkey, the toucan, and the elephant!”

Even households are divided. “It’s pretty much the only thing that will occupy my daughter and keep her in one place,” says Brittany, who lives in Japan with her husband and eight-month-old. “‘Purple Monkey’ sounds like it could be a Kidz Bop version of a Taylor Swift song. I’m into it. My husband is not a fan.”

Says her husband Tom, emphatically, on a separate thread: “I leave the room when Britt puts our daughter on that. It’s the only one I can’t stand.”

The Fisher-Price Kick & Play Piano Gym is a certified hit with my six-month-old twins. Like most of the parents I talked to for this article, I was influenced by all the noise around it on social media. But for once, the hype was real. My kids ignored the more aesthetically pleasing activity centers I’d chosen for them, lying there with a bored look best described as “ennui” during tummy time. With the Fisher-Price gym, however, they were smashing their little legs against the piano with squeals of delight and the force of a UFC fighter.

My colleague Dan experienced something similar. “I respect any toy that can take that level of physical abuse from a baby off my plate,” he says. “Between the dangling animals, infectious tracks, and flashing keys, there was enough here to easily occupy my baby for a solid 15 minutes. And raising a baby is really just stringing together 15 minute blocks of entertainment until you drop.”

The mat’s ability to keep newborns entertained for minutes at a time is valuable—really, really valuable when it allows you to pour a cup of coffee or pee—but that’s not what elicited such emotion from the parents I talked to. The mat’s viral success undoubtedly comes from the connection they feel to “Maybe.”

Written by Fisher-Price staff sound designer Jamie Hert, the song is intentionally nostalgic in sound: A spokesperson for the company confirms he used a ‘90s drum machine and digital bells to create the “retro vibe.” And if the lyrics (“Maybe you could be, a purple monkey in a bubblegum tree, and you could swing in the breeze. Then you could swing back to me…”) seem surprisingly deep, well, that was deliberate too.

“I was trying to lean into the emotional side of what it’s like being a parent and knowing their kids could become anything but hopefully they’ll always find their way back to the bubblegum tree (or home),” Hert says. When he first played the song to the broader audio team at Fisher-Price, he noticed a positive emotional response from several moms in the room. He had a good feeling then that it would work.

“‘Maybe’ is head and shoulders above the other songs for me because of its shocking depth of emotion,” says Sarah, who dressed her child as a purple monkey in a bubblegum tree for Halloween. “What’s funny to me though is that there are a ton of Reddit threads and posts online from people trying to figure out who the singer is. I guess it’s surprisingly hard? She’s like the millennial parents’ Banksy.”

(I actually have the answer to that: “Jamie has written thousands of songs during his tenure at Fisher-Price,” a spokesperson for the company tells me. “For ‘Maybe,’ Jamie worked with Sunn St. Claire who sings the song on the track, and we all agree she brings her own sweet personality to the tune.”)

I’m not surprised that millennial parents —a generation that’s embraced gentle parenting and Big Little Feelings —are so fond of a toy that evokes our own childhoods through ‘90s beats. Whether our kids will feel the same connection remains to be seen.

“I’m embarrassed to admit how many times I cried while listening to it,” Shannon tells me. “I would sit there thinking about the day when my daughter would leave the next and wanting her to know that she can always come back to me…meanwhile, my 3-month-old would look up at me like, ‘I can’t even roll over yet. Relax.’”

The Piano review – cockle-warming TV with a major problem at its core

As people play their hearts out on station platforms, this is undoubtedly stirring stuff – but there’s always been something terribly odd plaguing it too

T he new series of The Piano confronts the obvious problem head on. “I thought we were one and done,” Claudia Winkleman says to the talent show’s judges, Mika and Lang Lang, because everyone will know now that the pair are hidden away somewhere, assessing all the amateur musicians who step forward to take their place at the public pianos stationed at various – well, stations – and selecting the winner from each concourse, who will go on to perform in a special concert at the end of the series.

No matter, says Mika , wholly unconvincingly. It was the stories of the people that drove the series, not the big reveal. So, that apparently dealt with, on we go.

The Piano is undeniably a cockle-warming endeavour. How could it not be? You’ve got Winkleman’s warmth plus iron control over the scene. You’ve got a variety of ordinary punters who wander up to the gleaming ivories – in Manchester Piccadilly for the opening episode – sit down, and are suddenly transformed into gods of music before an adoring crowd and exclaimed over by the world-renowned pianist Lang Lang and pop musician-of-the-people Mika.

The selection process for these punters is still a mystery, but they are clearly a far cry from a random assortment. Everyone has a good story to tell or a revelatory taste in music. The Instagram-ready young blonde Brooke turns out to be a law student who loves classical music and plays Poulenc’s Novelette in E Minor, though narratively speaking she is beaten by Ellis, a boxer from a rough council estate (“high crime rate but we’ve got a Costa, so it’s all good,” he says, deadpan) whose mother saved up to buy him a keyboard from Argos when he was four. There was no money for lessons so he learned through council-funded schemes and his own hard work. He plays Chopin’s lyrical, lovely Ballade No 4 and takes everyone’s breath away. “Do you think he’s aware of how difficult this piece really is?” says Mika. Is that an odd thing to say? I feel it’s an odd thing to say – as if anyone from a council estate who can play such a piece must be a kind of idiot savant rather than a true musician.

But The Piano has always had these odd moments, when we are pushed up against our prejudices, because they are (at least as much as the big reveal or the stories) what drives the show. Look, an old man can still play! Look, a nine-year-old who seems to be on the autistic spectrum can play with emotion! There is an unspoken agreement that it is as amazing that Amy has pink hair and still likes Beethoven’s Moonlight Sonata as that she is self-taught, via tutorials on the internet.

But I am undoubtedly overthinking this. I would like to let the music soothe me, but unfortunately the same problem that plagued series one is back with a vengeance here. With the odd exception – such as the 18-year-old Caribbean gap-year student Fred’s transporting performance of Labrinth’s Beneath Your Beautiful – we get to see and hear almost none of it. We chop back and forth between player, crowd and Mika and Lang Lang’s commentary and get no real sense of what they are accomplishing. And the commentary itself remains hopelessly vague. The best of such reality shows – like Strictly Come Dancing, especially in its early days – educate the viewer slightly and add to the enjoyment by unpacking the skills and allowing us to appreciate them more. Here, the judges confine themselves to assuring us that they have just watched a very “mature” or “elegant” performance or that someone has “good technique” or “a soft left hand” (I don’t know if this is recommendation or not).

Nobody, moreover, seems clear on what the criteria are for anointing a winner. Is it the amount of raw talent on show? Comparison between the single performances? Or the heart-tugging nature of their backstories? It seems to be a bit of all of these, but applied thoroughly inconsistently. Claudia herself seems to have sway over the judges too.

It all makes The Piano feel a bit empty. Of course, the formula still works well enough overall. Even the fragments of music we get, and the love people express for it, suffice to get the tear ducts juicing. But with a little more thought, a little more bravery, a little more confidence in the amount of rigour and knowledge its audience would willingly bear, it could be so much more.

I Thought the Bragg Case Against Trump Was a Legal Embarrassment. Now I Think It’s a Historic Mistake.

About a year ago, when Alvin Bragg, the Manhattan district attorney, indicted former President Donald Trump, I was critical of the case and called it an embarrassment. I thought an array of legal problems would and should lead to long delays in federal courts.

After listening to Monday’s opening statement by prosecutors, I still think the district attorney has made a historic mistake. Their vague allegation about “a criminal scheme to corrupt the 2016 presidential election” has me more concerned than ever about their unprecedented use of state law and their persistent avoidance of specifying an election crime or a valid theory of fraud.

To recap: Mr. Trump is accused in the case of falsifying business records. Those are misdemeanor charges. To elevate it to a criminal case, Mr. Bragg and his team have pointed to potential violations of federal election law and state tax fraud. They also cite state election law, but state statutory definitions of “public office” seem to limit those statutes to state and local races.

Both the misdemeanor and felony charges require that the defendant made the false record with “intent to defraud.” A year ago, I wondered how entirely internal business records (the daily ledger, pay stubs and invoices) could be the basis of any fraud if they are not shared with anyone outside the business. I suggested that the real fraud was Mr. Trump’s filing an (allegedly) false report to the Federal Election Commission, and that only federal prosecutors had jurisdiction over that filing.

A recent conversation with Jeffrey Cohen, a friend, Boston College law professor and former prosecutor, made me think that the case could turn out to be more legitimate than I had originally thought. The reason has to do with those allegedly falsified business records: Most of them were entered in early 2017, generally before Mr. Trump filed his Federal Election Commission report that summer. Mr. Trump may have foreseen an investigation into his campaign, leading to its financial records. He may have falsely recorded these internal records before the F.E.C. filing as consciously part of the same fraud: to create a consistent paper trail and to hide intent to violate federal election laws, or defraud the F.E.C.

In short: It’s not the crime; it’s the cover-up.

Looking at the case in this way might address concerns about state jurisdiction. In this scenario, Mr. Trump arguably intended to deceive state investigators, too. State investigators could find these inconsistencies and alert federal agencies. Prosecutors could argue that New York State agencies have an interest in detecting conspiracies to defraud federal entities; they might also have a plausible answer to significant questions about whether New York State has jurisdiction or whether this stretch of a state business filing law is pre-empted by federal law.

However, this explanation is a novel interpretation with many significant legal problems. And none of the Manhattan district attorney’s filings or today’s opening statement even hint at this approach.

Instead of a theory of defrauding state regulators, Mr. Bragg has adopted a weak theory of “election interference,” and Justice Juan Merchan described the case , in his summary of it during jury selection, as an allegation of falsifying business records “to conceal an agreement with others to unlawfully influence the 2016 election.”

As a reality check: It is legal for a candidate to pay for a nondisclosure agreement. Hush money is unseemly, but it is legal. The election law scholar Richard Hasen rightly observed , “Calling it election interference actually cheapens the term and undermines the deadly serious charges in the real election interference cases.”

In Monday’s opening argument, the prosecutor Matthew Colangelo still evaded specifics about what was illegal about influencing an election, but then he claimed , “It was election fraud, pure and simple.” None of the relevant state or federal statutes refer to filing violations as fraud. Calling it “election fraud” is a legal and strategic mistake, exaggerating the case and setting up the jury with high expectations that the prosecutors cannot meet.

The most accurate description of this criminal case is a federal campaign finance filing violation. Without a federal violation (which the state election statute is tethered to), Mr. Bragg cannot upgrade the misdemeanor counts into felonies. Moreover, it is unclear how this case would even fulfill the misdemeanor requirement of “intent to defraud” without the federal crime.

In stretching jurisdiction and trying a federal crime in state court, the Manhattan district attorney is now pushing untested legal interpretations and applications. I see three red flags raising concerns about selective prosecution upon appeal.

First, I could find no previous case of any state prosecutor relying on the Federal Election Campaign Act either as a direct crime or a predicate crime. Whether state prosecutors have avoided doing so as a matter of law, norms or lack of expertise, this novel attempt is a sign of overreach.

Second, Mr. Trump’s lawyers argued that the New York statute requires that the predicate (underlying) crime must also be a New York crime, not a crime in another jurisdiction. The district attorney responded with judicial precedents only about other criminal statutes, not the statute in this case. In the end, the prosecutors could not cite a single judicial interpretation of this particular statute supporting their use of the statute (a plea deal and a single jury instruction do not count).

Third, no New York precedent has allowed an interpretation of defrauding the general public. Legal experts have noted that such a broad “election interference” theory is unprecedented, and a conviction based on it may not survive a state appeal.

Mr. Trump’s legal team also undercut itself for its decisions in the past year: His lawyers essentially put all of their eggs in the meritless basket of seeking to move the trial to federal court, instead of seeking a federal injunction to stop the trial entirely. If they had raised the issues of selective or vindictive prosecution and a mix of jurisdictional, pre-emption and constitutional claims, they could have delayed the trial past Election Day, even if they lost at each federal stage.

Another reason a federal crime has wound up in state court is that President Biden’s Justice Department bent over backward not to reopen this valid case or appoint a special counsel. Mr. Trump has tried to blame Mr. Biden for this prosecution as the real “election interference.” The Biden administration’s extra restraint belies this allegation and deserves more credit.

Eight years after the alleged crime itself, it is reasonable to ask if this is more about Manhattan politics than New York law. This case should serve as a cautionary tale about broader prosecutorial abuses in America — and promote bipartisan reforms of our partisan prosecutorial system.

Nevertheless, prosecutors should have some latitude to develop their case during trial, and maybe they will be more careful and precise about the underlying crime, fraud and the jurisdictional questions. Mr. Trump has received sufficient notice of the charges, and he can raise his arguments on appeal. One important principle of “ our Federalism ,” in the Supreme Court’s terms, is abstention , that federal courts should generally allow state trials to proceed first and wait to hear challenges later.

This case is still an embarrassment, in terms of prosecutorial ethics and apparent selectivity. Nevertheless, each side should have its day in court. If convicted, Mr. Trump can fight many other days — and perhaps win — in appellate courts. But if Monday’s opening is a preview of exaggerated allegations, imprecise legal theories and persistently unaddressed problems, the prosecutors might not win a conviction at all.
