About Visa to Australia

c505218304b50c59c3659f6dda43bae7-header-0--> Skilled Independent visa subclass 189 is a visa designed for invited workers, eligible New Zealand citizens, and eligible Hong Kong or British National (Overseas) passport holders with relevant skills to live and work permanently in any part of Australia.

It is possible to apply either onshore or offshore of Australia. Applicants can include dependent family members such as spouse/partner and dependent children.

A skilled independent visa permits you to live and work/study permanently in Australia, enroll in Medicare, Australia’s scheme for health-related care and expenses, get access to some social security payments, and lodge an application for Australian citizenship once you meet relevant requirements.

Important : Skilled Independent visa subclass 189 has been closed to new applications from primary applicants from 1 July 2023.

Skilled Independent visa requirements

To be able to apply for a 189 Australian visa , you need to satisfy the following conditions:

• Hold a visa : if you are in Australia at the moment of applying, you need to have a substantive visa, Bridging visa A, Bridging visa B, or Bridging visa C; if you currently have, or your last substantive visa was a Skilled Work Regional (Provisional) or Skilled Employer Sponsored Regional (Provisional), you must have held that visa for a minimum 3 years when applying;
• Have a suitable skills assessment : you should provide a skills assessment copy for an applicant’s nominated skilled occupation within the 60-day period of invitation;
• Be of acceptable age : you must be under 45 when you get an invitation to apply for the visa;
• Get enough points in a test:  your score must be higher than 65 points;
• Have a sufficient level of English language : have competent English proven by a relevant test result;
• Meet the skills requirement : your occupation must be in the list of eligible skilled workers occupations for the subclass 189 visa;
• Have health examination : you must meet minimum health standards and pass medical assessment;
• Meet the character requirement : applicants and family members aged 16 years and over must provide proof of a clean criminal record and truthfully answer all questions.

Note : Sometimes, your occupation may not be on the skilled migration occupation list. If this is the case, you need to think about what other occupations may be related to yours and look them up in the list. If another related occupation is in high demand and you fulfill the requirements for it, it may be your chance to get a Skilled Independent visa. For instance, if your occupation is civil engineer, you may look at the structural engineer, and if you are a livestock farmer, you may consider a dairy farmer occupation.

How to get a Skilled Independent visa

In order to obtain a Skilled Independent visa, you need to follow this step-by-step instruction:

• Check your eligibility: Review the list of eligible occupations and see whether your occupation is present; all applicants for an 189 visa to Australia must have at least 65 points in the skilled migration points test.
• Submit an expression of interest . You should let the authorities know you would like to obtain an 189 visa.
• Wait for the invitation : You will be ranked along with other applicants. If Australian authorities choose you, you will be invited to apply for the visa.
• Collect the documents . You need to prepare the required documents, 2 face photographs, including identity proof, Skills Assessment Report, English Language Test results, Character certificate, and other documents.
• Submit the 189 visa application . You need to apply within 60 days of receiving the invitation.
• Await the decision . You will be notified about the visa outcome in writing. You can be in or outside Australia while waiting for the processing of your visa application but not in immigration clearance.

When you are granted a visa, you will receive your visa grant number, information on the date when your visa validity begins, and your visa conditions. If you are outside Australia when the visa is approved, you need to enter Australia before the validity start date specified on your 189 visa grant letter.

In case of refusal, you will be notified why your visa application is rejected and whether you have a right to a review of the decision. Keep in mind that if your application is refused, your visa charge won’t be refunded.

189 visa processing time

Generally, applications are getting processed on a case-by-case basis. There is no exact time for all applications: every situation is individual.

The factors that influence the processing time for 189 visa include:

• the accuracy and completeness of the application form: errors and irrelevant details may cause delays
• how long it takes for you to respond to emails regarding your application: sometimes you may be required to provide additional information or supporting documents
• how much time Australian authorities need to check the information you’ve provided
• the amount of places available in the migration program

Australian Skilled Migration 186 189 and 190 Visa Options

With points rising from 60 to 65 in subclasses 189 and 190 on the 1st of July 2018, here is a reminder of the difference between subclass 186, 189 and 190 Australian resident visas.

Employer Nomination Scheme (subclass 186):

This visa is designed for people who already have an employer in Australia that wants to hire them.  You need to be nominated by an employer, under 45 years of age, meet skills, qualifications and English language along with the requirements specific to the stream you apply under.

• If you hold either the TSS (482) or 457 visas for Australia.
• Have worked for your employer full-time for at least 3 out of the previous 4 years in the same position or 2 out of the previous 3 years and your application is subject to transitional arrangements.
• If you do not meet the requirements under the TRT stream (for example, because you have never, or only briefly worked in Australia), this stream may then be available if your employer still wishes to sponsor you for permanent residence.
• This stream may be available if your employer wishes to sponsor you for permanent residence and has entered into a labour agreement with the Department that provides for a permanent residence pathway.
• Regardless of which stream you apply under you need to check first with the employer that they are willing and able to sponsor you for the 186 visa application.

Skilled Independent visa (subclass 189)(Points-tested) stream:

This visa is designed for people who are not sponsored by an employer or state/territory and you are applying based on your own skills and experience.  You need to be under 45 years of age, meet skills assessment, meet the minimum points benchmark of 65 and English language requirements.

Firstly, you need to find out if your current occupation is on the Skilled Occupation List ,

To be able to apply for this visa you need to meet a minimum of 65 points, this is based on your age, relevant work experience, English language capabilities, qualifications recognition, partner skills qualifications.  There are other areas where you can gain more points.  You need to have a Skills Assessment done so that it can be provided with your Expression of Interest.

The Expression of Interest is lodged with the Department of Home Affairs and is open for 2 years.  Within this time frame your name can be selected and you will be invited to apply for the visa, they give you 60 days to lodge the application.

Only once you have been selected to apply do you lodge the visa application itself, you need to provide confirmed of your selection with your visa application.

Skilled Nominated Visa (subclass 190):

This visa is basically the same as the 189 visa, with one major difference, it’s State/Territory nominated.  You still need to be under 45 years of age, meet skills assessment, meet the minimum points benchmark of 65 (of which 5 points are given for the nomination) and English language requirements.

You will need to go through the Expression of Interest for this visa as well, with the major difference being it is the State/Territory that will select you.  Apart from that, it’s basically the same process as the 189 visa application.

Once your visa has been approved you do need to remain living and working in the nominating state for at least 2 years.

Do I really need to give all my travel details?

Good question! This relates to providing Immigration with the details of your travel and address history. This includes a record of your short-term travels as well of your place of residence where you have lived for an extended period.

In most cases, Immigration forms ask for your travel history over the last 10 years and our clients often ask, “Do I really have to provide ALL the details?” and the short answer to this is YES! When the department asks for specific information, you have to provide it.

How am I supposed to find all that info from 10 years ago?

I feel for you and understand it may take a major effort to collect the details of your travel and address history. One of the ways to do this would be to check entry and exit stamps in your passport. However, this method alone is no longer reliable as many airports and customs agents aren’t stamping our passports anymore.

You could also check your travel itineraries, or reach out to friends and family who you may have lived or travelled with at the time. Still, your complete travel record is really important to have for your visa application process and it’s essential the information you give is as ACCURATE as possible.

What if I really can’t find or remember the information?

If there are periods where you really can’t remember the details, you need to give as much information as you CAN. You’ll see that some of the forms ask for the month and the year as opposed to the day , the month, and the year.

If for some reason, you can’t remember exact dates, Immigration does allow for example, ’01/01/2000′ to be the ‘dummy date’. But, when I put an application together, if I was to use a dummy date for a client, I will include an APPENDIX to clearly explain this.

Because remember, what’s IMPORTANT to Immigration is that they’re able to have an ACCURATE indication of your travel history and your address history over the past 10 years. So, if for some reason you are unable to provide this having exhausted all options to find it and have to use dummy dates, then it’s important to you provide an appendix to explain why you can’t recall or access the detailed information.

And so to recap, if your travel or address history is complicated or you can’t find the details, I would definitely recommend booking in for one of our Visa Planning Sessions . Together, we can assess whether this might cause a problem in your Visa application process.

189 visa partner not sure about travel history almost 10 years ago, will our visa be disqualified?

Hi all After university (around 2013) my partner backpacked and did volunteering work around South-East Asia for 1.5 years We don't know what the dates were, the passport has since expired and been thrown away and it was all travel on trains and buses. My plan was to write on the visa application explaining exactly what I've just written here "2013-2014 1.5 years backpacking around volunteering in Thailand, Vietnam, Laos, Cambodia" Is this OK?  

As long as you didn't stay in any of these countries for longer than 12 months - as that triggers national police check requirements. Input all the information to the best of your ability. If Case officer has any question he/she will ask. These sort of things doesn't constitute any reason whatso ever for refusal/rejection - not even a remote chance of that
